HISTORY OF THE CONTROVERSY. The question under consideration at Cumber- land, Md., yesterday was whether bituminous coal from thélMaryland mines for this District 18 to be allowed to be carried across the Balti- more and Obio railroad track to the Chesapeake and Ohio canal, for shipment to thts place. Some time ago the Baltimore and Onto rafiroad Purebased the Curaberlang and Pennsylvania and Connellaville and Pittsburg raflroads, the former running out of Cumberiand, Md., to the large Coal fields, known as the “Cumberland cval region,” and which had, up to that time, supplied through the shipping trade of George- town, Alexandria and Baltimore, soft coat for the north and east. At the same time the Bal- timore and Ohio railroad absorbed a majority of the stock of the Consolidation coal company, which corporation owned about three-eightns of the entire Cumberland region. The~Bltt- more and Ohio railroad thus secured a monop- oly of carrying coal, and the other companies were placed in a dependent tion. 1b was then determined to open up the coal flelds in the George's Creek region, and bring the coal in- to Cumberland by an independent road. A company known as the George’s Creek and Cum- berland rail: oad was formed, a charter obtained and the construction of the line,which is about twenty miles in length, was commenced. This Was two years ago. Since that time the Batl- more and Obio railroad company has bsen fighting its rival, aud almost every inch of the George’s Creek road has been marked by a con- test. The road, however, was completed to Cumberland, and the ties and ratis brought into the city. Here the troubie culminated. It pe- came necessary to cross the mainstem to the West of the Baltimore and Ohjo ratiroad. Tine latter corporation refused to allow its rival to cross its tracks, and the matter was brought into court. At the January term of the court the case was decided in favor of the George's Creek company, and the exact point of connec- tion was left to the poard of public works of Maryland as arbitrators. ‘The Baltimore and Ohio ratiroad then erected a strong barricade at right angles to the con- tending road, which has its tles and rails laid on either side of the B. & O. tracks andonly walts the final decision of the arbitrators to connect tbe separate rails. So closes are tiese ratls together—a double track and a siding only di- viding them—that they can be joined ina few hours. Close up against the barricade isa coal train, which was loaded at the George's Creek mines, and only awaits the connection to be switched on to the Baltimore and Ohio track and thence direct to the canal basta, where it can be unloaded into the canal boats. Of course it the right to cross or switch upon the Baltimore and Obio track is lost, no coal can reach here by the Chesapeake & Onio canal, The coal trade to Georgetown has in some years reached as high as 900,000 tons per annum, and unless the crossing is made the thousand3 of laborers now employed in and About the coal wharves and along the canal would be thrown out of employment. Eighteen hundred miners, nearly the same number of boatmen, have petitioned the board of abitration to grant the application of the George’s Creek Coal company. : XO CONCLUSION YET ARRIVED AT. Nearly two hours were speat by the board, the lawyers and the engineers yesterday in sur- veying the proposed crossing, in considering the feasibility of connecting by a switch, ot many places, around curves especially, the marks of wheels are plainly seen on the grass- plats, forcing on forbidden ground.
