Corkbill and Perry for the government, and Me-srs. W. A. Cook, A. B. Willlams and F. H. Falls for the accused—and certain exceptions taken to the rulings of the court were setUled. TO-DAY there was quite a large audience present. The overbinent stated that their witness (OMver tollihan) was sick, and therefore they closed. Mr. Cook, for the defendant, referring to the List of witnesses, said that the uame of Richard A. Norris appeared, and he submitted that the suthorities required the governmeat to call all their witpesses, Mr. Perry sald that asimmons had been ts- sued for Norris and returaed ‘non est,” and that If he were here the government, not baing entirely satistied as to bis faith, were not disposed to put bim on the staad. “They had attempted fo summon him, however, and falled, and If he was now present !t was through the defendant. Mr. Cook said In regard to this witness there Was somewhat of a coincidence in the witness for the government who would fall to sustain its theory not betng found. Tue defence navin s found Ubat this witness had not beea called had made an examination and ascertalaed Laat he had been so returned. Norris had beoa tn the District all the time, and his attendance cola) have been procured if he had besa re quired. Mr. Perry.—We ordered the subpeena and th question as to the return Is with the aarstal. Mr. Cook claimed that under the law every W tess should be called, and cited nam-rous authorities. Mr. Perry claimed that the government was Dot required to put on the stand every witaess, and read authorities to that effect. H» sun- mitted that after the statement of the govern ment, that they had no faith in his testinoay, nO ‘ourt would require the witness to be placed on the stand. My. Corkbill claimed that this question had been decided in the Hirth case. He clatmed that the government had directed the summons of Norris, and he had been returned non et and they were bound to respect the return. If Norris was here now it was not at the instances of the government, who certainly bad the righ! to elect what witnesses to pul on the staqd. Mr. Williams arose, when Mr. Perry gaid:— “Ler us bave adefinite understanding as to What is before the court. Mr. Williams rept ‘We move that this Witness be called py the government.” Mr. Porry.—"We say he was returned won Mr. Williams claimed that the law of Con- gress here (not the Michigan statute) gave the prisoner the right to have this witness called. Abtbis point Mr. Perry’s attention was catled to the returm of the marshal on a sudparna issued by tne defence to Norris at the corier of lth and T streets, and the explanation was made that the government’s subpe’na was at- rected to 1721 6th street, from which place he removed some months since. Mr. Wiliams proceeded, clatming that Norris’ bame being tn the list furnished, he should be called, and he asked that the witness be called. Mr. Perry remarked:—“ We say thal. the Witness has Deen returned * not found.’ If Nor- ris Is here he ts present under a subpena of the defendant.” Mr, Cook read the subpena of the government for Clarkson, Norris and Hackman, on Norris and Hackman are both retutued * not found,” and he called attention to Hackmia having been examined, Some further discussion followed, pending Which the court took a recess Ui | o'clock. AFTER RECESS. H On assembling Judge James decided that the Prosecutor 18 not bound to examine the wit- nesses on the Dack of the indictment: that the Mst Of wituesses furnished by the proseentor Was to prevent surprise to the defendant. It Was & common practice that such witnesses should be called. and he would therefore grant the motion that witness should be called in order that 1 should appear whether or uot he Was available, The bailiff! on the order of the court called Norris, who appeared. The Court intimated that the defenda moiton that the government should put wit on the stand would be overruled The defence then asked that Norris be placed on the stand, and the government ob} rary lengthy argument followed.
