ane anata. THE EVENING STAR, DOUBLE SHEET. WASHINGTON, SATURDAY.. January 15, 1851, CROSBY S. NOYES......Editor. The Evening Star bas a regular, perma- nent, bona fide dally circulation more than double that of any other daily paper pub- lished In Washington, and equal te that of all the other dally papers here added to- «ether. ‘Tae Braz office is connected with the Telephone Exchange. Advertisements, orders for the paper | by mail and otherwise, news,or auy information or | business can be sent day Or nixht, freeof charge. | ‘The District Code. The Dietriet code, as reported back by the Senate committee, does not contain any amend- | ments calculated to meet with any decided op- position in the House unless, perhaps, the one in relation to the selection of policemen from discharged soldiers and sailors be excepted. ‘Therefore, there ts no reason, apparent, why any conflict In the two houses should arise in the final passage of the code. The Senate com- mittee have, as arule, Mberallzed the code in itg provistons governing or regulating busines: affairs. In other words they have en- deavored to make the hand of law touch a3 lightly upon business, in all its branches, as fs consistent with proper considerations of revenue and protection. For instance, the Senate committee struck out the section fixing commissions to be charged by auctioneers, | leaving that to be regulated by that line | of business) When the code was under consideration, Senator Harris expressed him- self tn favor of allowing the people of the District as much Mberty in the management of their affairs 23 was practicable, and this view | has evidently obtatued with the committee. | Provisions that might have been made to bear heavily upon or interfere with the affairs of trade or business have either been stricken out or moditied. The section regulating Mquor Ueenses ts substantially unchanged ne sec- tion relating to the police, as it came from the , House, required that “at least se five per | cent of all appointments made to the police force urt:l January Ist, 1831, shall be from per- sons who served In the army or navy of the | United States in the late war and were honor- | « ably discharged.” The Senate committee very | properly struck this out, leaving the | code yithout any restrictions in regard | to selections for the police force. For several years past the District Commls- Sloners have been earnestty appealing to Con- gtess to repeal the existing law requiring the Soldiers and satlors to be glvea the prefer- ence as policemen. The Commissioners de- clare that the restriction limits them to too small a field toenable them to make up a police force of active, healthy and vigorous men; that the average soldier of the rebellion 13 now growing too old to make a good policeman. ‘The Senate, at the last sesston of Congress, | passed a repealing enactment, but it was de- feated tn the House. Should the House instst upon retatuing the seventy-five per cent. | clause tn the code, the Senate will no doudt ylela the potnt, preferring not to make any fight upon {tat tots late day in the session. | Of course, the prospect of the final passage of | the code is not altogether flattering, but as the | District committees of both houses intend to | make special efforts to push it through, tts | chances are fatr. | —— ‘The gercral run of criticism in regard to the Utah election case ts that Gov. Marray acted | arbitrarily In assuming to decide waich of the candidates bad been elected, Even thos? who | seek to sustain the governor's action dd not « 80 far as to maintain that under any taw he had | authority to go behind tue election returns and | determine the contest. Oae view of the matter | that ts quite common {s in effect that whilea | wrong, or at least somethinz not entirely right, | has been done, good may possibly come of it; that though Gov. Murray exceeded his au- | thority the result of bis act will force Congress | to take cognizance of tne Mormon question, | and msf led to legislation for the suppression | of polygamy. Tbis ts a mistal view of the Subject. Tuere will be no necessity for Coa- } ress to go into the Mormon question, tn order | to determine Mr. Campbell's rigat to his seat, | im the eveat Mr. Cannon shall contest. The | question will be substantially the same asthat | involved tn the former contest agxinst the sit- | Ung delegate. The committee on elections wil! | have to make inquiries as to the nataralization | Of the present delegate, and if the record prove: | bis citizenship that question will. then, be sei- | ted. As to the allegaiton of polygamy, that must be decided under existing law, which only disfranchises those persons who have been con- | Victed of that oflense. How anyboty can ex- j Dect a great test case to be made of th on question 3 beyond conception, in view of the | law and the facts, | ————~~re-—___ The bill fer the punishment of vVagrancy in | the District of Columbia as passed tn the Seaaie Seg, F985, appears to be deiletout In an impor- | tant ny, ™-_ Im the first section which desig- | nates the . /#¢eS, Such as steamboat landings, | bs “Mf amusements, stores, &c., about | banks, places. =~ = which persons, s. found ioitering,” are made Subject to the pena, is ioe f school Da. public or private. As we have said, the objection to this project ts not against the | high schoo! theory, but against the expendl- ture of any large sum of money for the erect: of the high schoo! building for the accommoda- | tion of asmall number of pupils while such numbers of the low grade schools are quartered | in damp, dark, unhealthy hovels. Ifthe high | ‘school building can be erected without Inter- | fering with the urgent work of providing better | quarters for the low grade schools, ail right; { but it would help the project a good deal in public favor if its advocates would demonstrate | that their plan of building 1s not of the showy | Shot-tower oréer, but a plain, practical struc- | ‘ture, solely adapted to school purposea.
