It now appear= governor of the territory bas decided that Mr. Cannon was not elected, notwith standing his majority of about 17,000 votes, but In the cle in Congress that Mr. Campbell was, and the certifi cate of election has been fssued to the istter. The ground taken by Murray, of Utah, in his reported by the press dls Mr. Cannon Is not, Or was not at the time of his ‘lection, a citizen of the United States. Mr. Cannon bas represented Utah tn Congress for some years past, and once before hls right to the seat was contested on the same ground now taken by Gov. Murray—that he was not a citi- zen. The election committee of the House, in the 43d Congress, after investigation, decided and reported that Mr. Cannon was a citizen, and he was permitted to retain bis seat. Ht subsequently sat in the With, 45th and 46tn (che Present) Congresses. Aside from the question of fact as to whether Mr. Cannon has been regularly naturalized or not, there is another Point of interest which will be involved In the contest for this seat. This {s a question of the right of the governor of a Territory to exer- cise judictal funetions in the Issuance of a certiticate of election to the delegate. The law Providing for territorial representation tn Con gress (Revised Statutes, see. 1,562, page 329,) 1s as follows: “Every territory shall have the right to send a delegate to the House of Kepre- Sentatives of the United States, to serve during each Congre-s, who shall be elec by the voters in the territory qualified to elect mem- bers of tbe legislative assembly thereof. The Person having the greatest number of votes shall be decisrea by the governor daly elected, and a certificate shall be given accordingly.
