PROCEEDINGS IN COUST TO-DAY, ‘This morning, in the room of the Court in General Term, Chief Justice Cartter resumed the hearing of the case of Samuel L. Perry, the colored man, (alleged to have been the leader of the exodus trom North Carolina), arrested oa warrant issued on a requisition from North Carolina, where he is —— with forgery— Mess1s. ‘Shellabarger, J. Wilson and T. Greener, for the prisoner, and Messrs, R. T. Mertick and RS. Davis for the state. At the conclusion of the arguments yes erday, the Chief Justice stated that in consequence of in- ‘mations made that this man was wanted in North Carolina for objects other than that Which appears on the papers, and he would, therefore, give the parties an opportttnity ‘6 present testimony, In consequence of this announcement, there was quite a crowd present this morntog, anticipating some interesting proceedings. Mr, Wilson sald that they had deemed it wise, ifthe conclusion should be against them to petition fora writ of habeas corpus, that the case might be passed on judicially and not as an executive act. Mr. Merrick remarked that the other std2 should have that opportunity, and he would Say that should the decision be against the prisoner, they would have him where the writ could be served for 24 hours if need be. JUDGE CARTTRR ORDERS THE PRISONER INTO THE CUSTODY OF THE NORTH CAROLINA AUTZOsI- Tiss. Chief Justice Cartter then announced hls d. ciston, ordering the prisoner in the custody of the agent of the state of North Carolina, After referring to the law on the subject, he said they contemplated that the executive should act ta more than as a ministerial office; that he 13 to enquire as to what ts presented fa the record least. How was an executive to know tf a crim: had been committed? He could not do tt by looking at the great sea} of the states, and he is to be iniormed by the iudictment or a@idayis. itismade part of the paper. The ques‘ion iz how faramaa may go tuto detatls, and to zo further than inspect the papers woull be 80 invasion of the Jurisdiction of the stain. He could go no farther than inquire if acrime is substantially charged. In the executive view of the subject he thought that acrime had been charged and certitied, too, and this was sufficient. He would not knowingly trust a man to be taken out of the jurisdiction of the court, but he did not know that this ageat wa3 hot a proper party, for he appeared to be a re- spectable mat. He would not presume that he was a brute. This requisition comes from one of the old thirteen states, which had up to the rebellion been considered one of the most con- gservative of all the states. He was aware that there were some dark places ip the repu: where men had been manacled and slaughterec tut such cases were. exceptional Be woul take it for granted that this man would be kindly transferred to the place of trial, and faivly treated after he is there. The defendant will be ordered into the custody of the agent of North Carolina, WRIT OF HABEAS CORPUS. The counsel for the prisoner immediately called him to the clerk’s desk, where he swore to a petition for a writ of habeas corpus, setting forth that he was unlawfully detained 1a the custody of George K. Bagbey, on an order of Chief Justice Cartter, he having been arrestei by virtue of a requisition from one Thomas J. Jarvis; that said requisition is fnsuficient and illegal; that the alleged crime 1s not properly certified to; that he is not guilty of said alleged offence; that he has not fled the jurisdiction; and, further, he believes that his extradition 13 not Sought in good faith, tut because of his relation to ceria‘n political affairs, ineinding the so-called negro exodus; and that he belfeve: that ff he is sent to North Carolina he will be in great bodily dauger. ‘he writ was presented to Judge Wylie, who ordered the writ to issue, returaable before him at chambers forthwith, Mr. Bagbey, the agent of the state of North Carolina, made his return at once, that ha has the body of said Perry In custody aud under the authority mentioned, and deatles spectiically the allegation that he (Perry) ts wanted for ee purposes than what appears on the writ, PERRY UNDER BAIT, Mr. Merrick then presented a stipulation that the hearing be postpened until November 51h, at 10 o'clock. Some six weeks ago the officers of the Metro- Folltan railroad became convinced that certain parties were endeavoring to introduce among ‘the conductors of thelr road, and in the employ of other roads, a new style of ‘* little joker,” or begus bell punch. Steps were at once taken to ferret Out the instigators of the movement, and it was ascertained that there were several dis- ines panes who seemed to be working for the imtroduction of tie instrument. The conduct: Ors, as a rule, fought shy of the proposition, bu here and there men were found who eagerly bit at the tempting balt, and purchased the “ jo- kers” at a price said to be about $10 each. ‘rhese bogus punches have been in use on several lines of the Metropolitan road. and {t is believed on the cars of other Boz ton street railway corporations, for several weeks. The punches vary in shape, but are usually hemispherical in form, aud a litte larger than the broadest end of a hea’s egg. ‘They are rung by means of a projecting sprit which, being pressed in the closed haud of the conductor, rings out clearly, and by its sound is well calculated to deceivetne ear. It is need- Jess to add that there Is no punch connected with this devise, and the tickets find thelr way imo the pockets of the conductor intact, and are worth to bim the sum of 5 cents each. The trip siips also in lke manner escape betug punctured, and the cash taken for fares also £0es into the couductor’s pocket for his benefit, and uot for the benefit of the road. It has been asserted thata “bold operator” can, by using the “joker,” clear several dollars 2 day, and yetrun comparatively small risk of detection. Yesterday afternoon state Inspector ‘ade, assisted by officials of the Metropolitan rail! road, arresied four conductors suspected of using the bogus punches, besides parties implicated in their salé and = introduc. ton. Thelr names were Conductors Cook the East Boston (Tremont street) line, and cott Bell and Mariner, of the West Had Mae, in some Instances the “little jokers” were found upon thelr persons. George M. Brainar aD employ of the company in the telepho: department; a man named William S. Preseatt, a coal Gealer at the corner of Beach street and Harrison avenue, and Herbert C. Davis, a ing Ipachine agent at 175 Washington st were also arresied. It seems that a condi Was some tine ago approached by Prescott, who offered lim one of the bogus punches for a consideration; the conductor purchased tt. whereupon Prescott, remarking that he had other business to attend to, olfered to introdave the Can Sica to a man who could furrish them to his associates. Prescott then introduced the conductor to Davis, and the result was the extensive sale among street railway conductors. It is believed that this summary action wit) result in saving the road many hundreds of dollars, as other conductors who have them in ‘Ubeir possession, realtzing that their little game ig known, will get rid ef Ubem without delay.— Boston Herald, TRAVELLING BY STAGE COACH in Nevada 13 en- livened tre ae by incidents. For exampie, Freld and Moody sat ia the same seat of a crowded coach on the Bodie Une. Moody sur- lily sald that Freid was a more than a fair share of the space, and when Freld replied that he couldn’t move eny further, coolly Shot him “I bever take any nonsense,” he remarked, as Freid fell dead from the seat. The driver Gor down from his box, and told the murderer to getcut, A defiant refusal and a flourish of the Weapon were the answer. The driver jurap up Ch the wheel, seized Moody by the’ collar, aregged him out ‘through a window, and tirew him to the ground so forcibly that his arm was bieken, The passengers heiped to tle him wich alope. and he was stowed away with the cranks behind along with the body of Freid, after WLich the journ as continued.
