Perry, the colored messenger of the second auditor's office, arrested on Monday morbing last on a Dench Warrant a3 a fudtive irom justice in North Carolina, where he 13 charged with uttering a forged school 2ertt- flea'e for $5. It will be remembered that a requisition from Goy. Jarvis was brought here by the sheriff of Lercn county, tn tuat state, on Monday, on which Perry wag arrested, and that cn Monday afternoon Judge Carcter ‘post- poned the hearing watti noon today. Messrs. T. Merrick and R. 8. Davis was apoointed for the state, and Mesars. Shellavarger, J. Wil- on and R. T. Greener for Perry. Mr. Davis opened the case by reading th dicticent and the sections of the Revised utes authorizing the chief justic? to act in such a@case as this (sections 627 .) He claimed that when a requisition 13 accomp nied by a copy of an indictment or an affidavit made before a magistrate itis conclusive; that the chet justice occupied the position of an execu- lye. Tobe Chiet Justice asked if it was not his duty to know tf a crime bad been commitied Mr. Merrick satd the practice was that when an indictment accompanies the requisition 16 15 prima facie evidence that a crime hal been committed. ‘The Chiet Justice sald that he regarded it a- his duty to inquire tf a crime was e the executive Inspect the indict purpose? Mr. Wilson.—And when that door is open we Will show that the officer has been attempting to get this man out of the jurisdiction of the court by mean subtertuges, t The KAS for the day is the evil hereof. Mr. Wilson continued, claiming that the law Was not complied with, as the certificate was not that the indictment Was authentic, He then read the Indictment, closing w§ih the words “A true copy,” and asked: “A true copy of wha‘ It does not say indictment, and, for all th court knows, the paper may have been written at seme corner grocery. Mr. Wilaon claimed that there was noth- ing toshow that the parties named had any connecticn with the school fund. The constttu- {ion and statute requires that the party mist be chargd with acrime, but there 13 ap utter absence of averments, and he claimed that it amounted to nothing. On the point that the Court cannot look b-bind the seal of the state, he referred to the Kimpion case, reported in the American Lair Revit for Isis-79. a8 showing that the law recognized the right of the a- lve fo look into the papers and inquire whether the requisition was made In good raith, whether {i was not a subterfuge.
