Subsequently Gen. Birney, who was Jones’ counsel. called on the same subdject. In the case of Miss Smith the witnesses testified quite positively as to Jones being the man, and his eneral Sa given by her fitted him. in the Miss W case there are certain cir- cumstances which point to Smothers as the guilty man; he having been one of the parties ayresied at that time as answering the diserip- tion given of the assailant. Miss Wilson after- wards admitted having seen the party who committed the deed, but suppressed her feel- ings, fearing that her father would shoot him, and thereby get himself in trouble.
