TRIAL. OF TOM SMOTHERS. In the Criminal Court, Judge James, the case of Tom Smothers, colored, indicted for rape and attempt at rape on the person of Miss Lena Leins. on the night of February 27th, was re- sumed this morning—District Attorney Corkhill | and Mr. R. R. Perry for the governinent, and | Messers. Ken jamin Davenport, assisted by How- ard C. Clagett, for the prisoner. There was éven a smaller attendance to-day than on the previous days. The jurors were breught tnto court promptly, and the sick juror, Theo. C. Ray, stated that he was much better, and was prepared to proceed with the trial. The witness under examination on Tuesday after- noon—Dr. J. W. Bayne—resumed the witness stand. and testified further to the injuries of Miss Leins, showing that the crime had been committed. Her voice became almost indistinct, and so continued for some weeks; the tempera! ture of her body became such as to excite alarm, but these symptoms gradually passed away. Ou the 4th of March he made another examina- tion, more minute than before. She wascon- fined for a month or more to her bed, and for some little time her condition was such that her recovery was exceedingly doubttul. Mr. Davenport cross-examined Dr. Bayne at Some length as to the wounds, and he described them, the cut on the head penetrating to the bone. but not indenting the bone. The wound on the ear nearly cut or tore off the rim of tt, and his impression was that it was made by @ rock held in the hand of the assaliant, out it may have been made by a stone thrown. Harris. Bishop Thompson gave an eloquent biographical sketch of the Ufe and services of Rt. Rev. J. J. Clinton. At 10:30 o'clock Bishop Clinton appeared. having somewhat recovered trom yesterday's illness. "The annual adress of Bishop Clinton was read and referred to the committee on address. The discipline question was taken up and discussed, and it was found that Bros. St. Clair and Mitchell were still on trial, and that oihers are admitted to full con- nection. A resolution was adopted that the considera- ton of credentials from the church at Lancas- ter be Jaid over until Saturday. Rev. L. District Government Affairs, The amount received on account of special assessment taxes yesterday was $1, rhe District Commissioners have notified Mr. H.C. The total mortality in the District of Co- lumbia for the week ending Saturday, April i0th, 1580, was 100, or at the rate of 20.5 per 1,000 per annum. Of the decedents 2s were white males, white females, 27 colored males and 26 colored females, showing an annual death rate of 21.44 per 1,000 for the white and 49.21 for the colored population. Goersen, charged with hay- ing caused the death of his wife by administer- ing arsenic, still excites considerable public at- tention in Philadelphia. Suspicion rests agains: him for having also been concerned in the death of his mother-in-law, Mrs. Souder, and permission has been accorded toexhume the remains for examination. Mrs. Goersen before her death willed her property to her husband and this will is to be contested by the wife’s brother.
