THE EVENING STAR. | WEDNESDAY - April 14, Isse. TRIAL OF TOM €MOTHERS. In the Criminal Court, Judge James, the case of Tom Smothers, colored, indicted for rape and attempt at rape on the person of Miss Lena Leins, on the night of February 27th, was con- tinued after our report clesed—District Attorney Corkbill and Mr. R. R. Perry for the govern- ment, and Messrs. Benjamin Daven, assisted by Howard C. Clagett, for the prisoner. Miss Teins having testified’ in chiet she was cross- examined at some length by Mr. Davenpert, but @id not vary her statement as printed in yester- day's Stak. Dr. J. W. Bayne testified that he attended Miss Leins near midnight after the outrage; he found her sitting in a chair by a table with her face buried in her hands; when she locked up | Witness saw her eyes Dlosdshotten and swollen, | until they were almost ciosed, her face bloody. and her hair heavily matted with blood; behind | her right ear was a fresh wound, which ran the whole length of the ear. and ex the bone, | Which was jagged as if torn by some rough sub- | Stance like the sharp edge of a rock; the rim of | her ear was cut, her throat swollen ané sensi- | tive, and skin seraped from her tongue by the | Indentation of finger matis; she hac been | choked; the back of her head’ was brutsed and | Swollen as if from a fall. Without concluding the examination the court adjourned, and directed that the jury be kept together until the close of the trial. ‘The jurors Weare accordingly sent to a hotel ih change of a Second Bay. This morning, on the opening of the evurt, aside from the prisoner, the counsel, the jurors and court officers, there were only fifteen per- sons present, but in a little time this number Was somewhat tnereased. There were many appleations on the part of the public for admis- ston, but the marshat’s oficers strictly carried out the orders of the court. SESS OF A COLORED Ui jurors, Mr. Theo. C. Ray, colored, appeared to be ill when they tcok their seats thts morning, and he stated to the court that he ntd been quite sick. After some conversation it Was suggested that an adjournment be taken until one 0’ dock, and in the meantime that he should have medical attendance. A hote was received from Dr. Bayne, whose examization bad not been concluded yesterday when our report closed, stating that he was in attendance upon a very critical case, which he could not leave without endangering’ life.
