The doctor, however, suspected that. she had given birth to a child, but, as juested, made enly an external examination of the patient. The evidence of Eliza Scoggins, a nurse, was however, of a more positive character as to the fact of Miss Mitchell's having given birth tos child, and other corroborative testimony was given. The jury returned a verdict that, in their opinion, Miss Mitchell gave birth to the infant at the house of Miss Ann E. KEARNEY DEFYING THE VIGILANTS—Manifesto of “The Citizens’ Protective Cnion.»—The Citle zens’ Protective Union have prepared a manl- festo to the people of San Francisco and the state of Calffornia, which will appear in the Call t0-d declaring the object of the organt- zation to be—tirst, the preservation of public peace; second, protection of life and property: third, restoration of confidence in the security of life and property from all violence, and fourth, the resuscitation of legitimate’ com- merce, industries and business of the people, The manifesto, which ts signed “By order of the council,” expresses the determination of the unfon to suppress all violence, and appeals to all good citizens to range themselves on the side of law and order. It is understood that the address 1s ut forth by a body representing the wealth and business Interests of the city, inclu- ding some who have been prominent in times past in measures for the preservation of the city from the designs of the disorderly and crim- inal element. During yesterday about 150 men were engaged obtaining ignatures to the roll or the Citizens’ Protective Union with decided sue- cess. To a very considerable extent the project finds favor with the business classes, though mang question the wisdom or necessity of such a movement. Kearney was interviewed last night relative to the vigilance committee. He 1s cenlant and evidently looks on the present ex- citement as furnishing him with fresh weapons. Yesterday morning he bought a Winchester re- peating-rifle, which he keeps in his sleeping- room, and both his brothers, who live with him, are provided with revolvers and shot-guns. Gazetie, 10th, ‘THE KEMPER COUNTY (Miss.) MURDER TRIALS. The case against virgil and Houston Gully in the circuit court of Kemper county, Miss., for the murder of John P. Gilmer was taken up Monday. Henry, Virgil and Houston Guily were all indicted together for this offence, but on motion of the state a severance was granted. ‘The two latter were elected to be tried first, and next Thursday was set for the trial of’ the former. ‘The special venue of seventy-five that had been summoned and the two petty juries for the week were, on Monday, exhausted, and out of the number only two jurymen have been obtained, both negroes. The court then ordered the sheriff to summon 100 good and discreet men to appear and answer with reference to thelr qualifications as jurymen in this case. It will be a difficult matter to get a jury on account of the notoriety of the case and the fact that almost every man in the county has formed or expressed an opinion tn re reserenoe to the guilt or innocence of the accused.
