Edward Bean was charged with an assault and battery with intent to kil Smttit Phillips, both colored. Phillips testified that on the 23d of last month, he went to Bean’s shoe shop to get a pair of shoes which he was repalr- ing for him, and on being told that they were not ready he began to remonstrate with him, when he (Bean) picked up a hatchet and struck him on the head with it, knocking him down and striking him several times with the hatchetwhen hewas down. took the stand and testified to about the same taets, except that he stated that Phillips attempted to strike him before he struck Pi enlpe ps with the hatchet.
