Major Smith says he believes the controversy has ended. SIGEL TO Pay.—Henry Van Schaick lent George Scott $4,100 in 1874 On property on East iosth street, a Certificate of search having been obtained from the register’s office deciaring that the property was free from incumbrance. Afterwards he discovered that Edward Coffin. jr., held a prior mortgage on the property for $2,500, and when this mortgage had been’ foreclosed there remained only $1,506.11. Van Schaick there- upon sued Gen. Franz Sigel, who was register 1n isv4, for the defictency, alleging that 1t was by his neglect in not reporting the Coffin mort- gage that the loss occurred. Gen. Sigel de- fended upon the ground that he coud not be held responsible unless he had signed the certificate personally and that the plaintiff had a clerk in the register’s office to e the search. Judge Larremore, in the court of com- mon plea: ve an elaborate opinion yesterday in favor of the plaintiff.—v. Y. World, Mt. AN INDIGNANT HEIR,—A telegram from Greens- burg, Pa., Jan. 26, says:—Attorney A. A. Stew- art, this morning, was having read the will of which be- queated an estate and bonds valued at 40,000, of which nearly all was to go to Brant’s grand- children. Andrew George, a son-in-law, asked tosee the will. When it was in his possession he quickly threw it Into the office fire and there held it until it was entirely consumed.
