Browning appeared for the accused. Mr. Minor testified that he purchased the wagon on October 16th from Edward Butler with the horse and harness, giving in payment $45 in two notes of hand, one for 30 and the other for 60 ai for which he produced Butler's receipt. He first met Butler on the highway near Fcir- tax Court-house. Witness atverwards brought the horse, wagon and harness to this city. Here, recently Butler had come, and finding the wagon standing in the alley, had removed it to Alexandria, as he is informed. The notes, of are over due but will be paid. One of mly had been presented to him for pay- ent. A small-sized white girl who saw the transaction testified to seeing the receipt for the notes given by Butler to her father at their house in Fairfax county the tre bargain had been effected, and saw Butler make is cross-mark, and saw the witness sign the paper. Butler took the stand and said he never gave that receipt, and knew nothing about it. He met Minor on the road. and Minor forced him with a pistoi to ils head to give him the horse and wagon, and thrust two notes upon him. Witnessis an ignorant man, and cannot read or write. It did not look at all reasonable that the property was obtained in the manner desccibed by defendant, who comes into court with the two notes he acknowl- edg have taken for his property. Cook has entered an appeal from the judgment of the Equity Court which dismissed her suit against Prof. T, A. Cook for divorce, and his suit against her for the same object. TWO NEW CASEs OF VARIOLOID were reported about mid-day—one at 313 3d street soutewest, and one‘on 3d street, between L and M streets northwest. No deaths have been reported. Yellow flags have been placed up at all places where the disease exists. Thus, far, since the appearance of the disease tn this District, but thirty-six cases have been proved to exist, and but very few deaths. A YOUNG MAN DYING FROM A PISTOL WOUND IN THE HEAD. ‘The people of Georgetown were thrown into a state of excitement this morning by the report * the murder of a young man named Patrick id, on Capt. Reeside’smafl-packet Ella.
