In the Philadelphia court of common pleas, last week, Judge Elcock delivered an opinion in the case of Freeman ys. the City of Piiladel- phia. The plaintiff had been non-salted, and the opinion relates to a motion to take off the non-suit. Judge Elecock said: “The plaintiff, while driving his horse attached to a wagon on Arch street, in this city, was rua into and se- riously injured by the rapid and careless driv- | ing of one of the engines of the fire department of the city, while in charge of one of the mem- bers or officers of sald department, and the case as presented raises the stion whether the city is Mable for such negligent conduct.” He then refers to decisions in a large number of cases in the law books, incinding the celebrated ease decided in this city, of Weightman, (in- Jared by the fall of a bridge,) vs. the City of Washington, and concluded by saying: ‘* Walist it may be a hardship upon the plaintif to be thus injured, the public good requires that he should look to the individual who occasioned the injury and not to the corporation within ‘whose bounds it happened. No power but the legisiature can impose such a liability upon a city, and it has wisely remained silent. J.T. for the presidency, but, ac- cording to the Philadelphia Times “ it may not be so easy for them to hold their ground next year.” Diphtheria 1s prevailing toa remarkable ex- tent all over the world. In this country it has exhibited itself in a malignant form north, south, east and west. It has shown itself in nearly every country of Europe, and in Russia its ravages have been more fatal even than the Plague. This disease, which rarely occurs ex- cept as an epidemic, has only been known in this country within the last twenty-five years, except in the way of occasional sporadic c: it has not yet been settled whether the alse: iscommunicable by infection or contazion, or whether the parasitic fungus frequently found 1n the false membrane is the cause of the dis- ease or only its product. ———_—__ +--+ —___ ‘There are indications that the Chisolm mas- Sacre is to be utilized extensively as political campaign capital. It ts evident that the finding of the Court of Inquiry in the Fitz John Porter case will not close the discussion. The newspaper toquiry bas now been entered upon, and a hundred Papers are devoting columns toit. The New York Times has an elaborate article upon the diversity in the findings of the court martial that condemned Porter and the court of inquiry that exonerated him, and concludes that these Fadically different views of the same transac- tions will revive the old discussion as to where, in the military profession, discretion ends and disobedience begins. —~+-+—___ The New Yorkers are already wrangling about the proposed International Exhibition there in 1863 In away not very promising for the success of the undertaking. The quarrel which has developed so early in the proceedings is in regard to the site of the Fair. The managers had fixed upon Central Park as the proper place, but the Park Commissioners and most of the New York papers hotly oppose the use of «the city’s breathing place” for that purpose. ‘The Fair managers assert, on the other hand, that no real inconvenience would be felt by the public in the temporary use of suMicient ground im the park for the exhibition; and they say that it is the only place in the city where there is sufficient space, which is easy of access and where financial success will be possible. Tne hotel proprietors and other busines; men also oppose carrying the exhibition further away from the center of the city than Central Park; for the reason that business will thereby be taken away from them by the host of mush- room structures erected in the vicinity of the out-of-town Fair. Various other sites are suggested tor the Fair, Amongst them Staten Island; Prospect park, * Brooklyn; Garden City, and various plots of ground above Harlem river. Philadelphia meanwhile demurely suggests that Fairmount park is, after all, the best site in America for an international exposition, and advises the ‘New Yorkers, as they have no good site of their Own, to borrow hers. On the whole, Philadel- phia manages to get a good deal of solid com- fort from the squabbles of the New Yorkers about their exposition, as contrasted with the unity of purpose displayed by her own citizens im successfully organizing the Centennial. Quite naturally, too, Philadelphia is not averse to bearing Knickerbockers confess that Cea- tral park 1s not big enough for a world’s fair, and is in this and other respects altogether in- ferior to Fairmount. Manifestly the New Yorkers must work together a little more har- moniously ff they want to inspire the country with any confidence in their show of 1883.
