H. Wells, jr.. for the ent, Messrs. A. K. Browne and R. T. Greener, defendants. It will be re- membered that Stone, who is a well-known ‘ellow man, employed for several years as the Janitor of the Associated Press rooms, resided some time on New Jersey avenue, near the B. & 0. depot, and he and his wite parted. He would not take the case from the jury, for he was not afraid they are going to run away with justice so long as he bad the reins in his hands. He overruled the motion and adjourned the court. PROCEEDINGS TO-DAY. This morning there was but a small attend- ance in comparison with that of the last two weeks. On the court convening the (apg submitted prayers for instructions to the jury, in substance as follows: 1, If they believe there was.a contract of mar- riage, and plaintiff requested defendant to con- summate the contract, they should find for the plaintiff. Granted. 2. In the absence of express stipulation the jury may infer, from the conduct of the parties towards each other, that such stipulation ex- isted. Overruled, and exception noted. 3. That they may infer plaintiff's acceptance from her bearing tow: defendant. No ob- jection was made, and this prayer was granted. 4. If they find that they kept upa correspond- ence they may infer a mutual promise. Mr. Cook.—‘‘If that be so, all lovers who cor- respond are bound to marry.” e court refused this prayer, remarking that lovers may write to each other without raising the presumption that they are bound to marry. Overruled, and exception noted. 5. They may determine from the circum- ‘stances the promise to marriage.
