Yesterday, in the Criminal Court, Judge Wylie, the trial of Edward Ray, alias Major E. H. Curtis, alias Richardson, alias Hough- ten, charged with having, on the 24th of March, i577, committed a rape on the person of Ella ‘jydings, an orphan girl of Baltimore, in a | room at the National Hotel in this city. was continued after our report closed—Messi Cook and Corkhill for defence, District \orney Wells for the government. Karsner (clerk Baltimore Sun) Was the first witness, and he testified that his | ¢' impression was that the prisoner was the party who inserted an adveriisement in the Sun’ March 2st, 1877, for an orphan girl, directing addresses to “Country Merchant Edwin Guy, room clerk at Baraum’s, in Bali more, identified Curiis as the man who r tered there on the lyth of March, and remained several days. Robert Brashears (newsdealer) testified to seeing the prisoner: at Barnum’s. Paul E. Dorsey testified to seeing Curiis in Baltimore March 1877, and to having known him in New York under the name of Richard- son, and L. A. Chase, of New York, to having employed the prisoner in New York, in. 1875, under the name of Richardson. Mrs. Sarah Johnson, sister of Ella Tydings, recognized Curtis a3 the man who employed her sister Elia to go to Alexandria, Va., a8 a nurse: wit- ness heaid him agree that Elia should be paid #3 per month, and be allowed to return home after two weeks’ trial if she did not like the place: knew that she left next day for Alexan- dria, and that on the day following she came back much injured. . She was cross-examined, and an unavailing effort made to prove by her that Kila’s charac- ter was not good. Mr. Cook said if he could show that she has lived in disreputable localities, he would be showing elements going to make up the reputa- tion of a street-walker. Judge Wylie ruled that separate facts could not be proved; general reputation only can Le put in evidence. If specific facts could be introduced against a_ witness, any prejudiced scoundrel might suddenly and without notice be put on the stand to Swear away the char- acter of a witness ina manner that admitted uo possibility of disproof. He recollected the Wiley-Lrown case tried here some time since. In that case there was not merely one per- jured witness, but there were fifty. The court house was filled with perjurers. The court must hold that witnesses could be held only to meet charges against their general reputa- tion. The counsel for the defence having ex- pressed a desire to argue the matter to the court, Judge Wylie said he would allow them to do so to-day. The court adjourned. . SECOND DAY. There was another large crowd in the court room this morning, and it was remarked that when notice was given that the jurors cry Witnesses not engaged in the ease on trial were discharged il to-morrow, not one of them left. Prior to the court being convencd the accused had an interview with dy in the marshal’s office, and also one with Col. Corkhill, in one of the upper rooms of the court house, Mr. Cook proceeded to argue the point made esterday as to assailing the character of Mis Yyaings, by proving s lie acts, to which ob- fection was made by the government. Mr. ells followed, and Judge Wyii id that Ella Tydings, in this case, was no more than any other witness, and the rule of law as to the impeachment of a witness was that it must be done by proving the general reputation. and not by specific acts. The defence excepted to the ruling of the court. A memorial complaining of the odors and gases arising from the gas works Was received from the District Commissione.s, with an endorsement stating that the measures adopted by the board some two months since had been unsuecessful in abating the nuisance. The board decided to visit the works to-mor- row afternoon and make an inspection. The health officer was directed to demolish the frame strueture corner of 10th and R streets. The report of the registrar of vital statistics for the month of March was submitted. The mortality in the District during that month a ing 21 less than the corresponding last year. The annual death rate per 25.815—white, W641; colored, 38.34. was 25.’ Births (reported) during the month, 32 white, 191; colored, 139. Parker, of Washington, brought an action of ejectment against Misses Elizabeth and Jennie French, of Prince George’s county, for a house and lot which they have occupied for many years. The trial engaged the attention of the court and jury for several days. The ease excited great interest. The jury, after being up all night, returned a verdict for the ladies. These ladies have, through their coun- sel, Gen. Carrington, entered a suit against Mr. Parker for malicious prosecution, laying their damages at $10,000. e Misses French are the daughters of the late Wm. He was playing five-cent ante in a saloon and there were four in the pot. A dispute arose and he made use of a phrase such as this: “I hope Christ will kill me if it isn’t so!” He had dealt the hand himself, and as the betting was over, he passed the ecards to the Player on his left, who shuffied them and then asked him to cut them, giving him a light tap to attract his attention.
