ANOTHER Covr.e From Vir- Grsia— Their Elopementand Marriage.—The train from the south, reaching the Balt and Potomac depot about Lo'elock yt morning, brought up a good-looking young couple from Stafford county, Virginia, deter- mined on matrimony. They were met by some friends and escorted to the residence of Mrs. Corbin, on Defrees street. Their names were - about twenty-three years old, 1 Miss Sallie Combs, about nineteen. Gred persons, who paid their entrance fees— fifty cents each—and waited patiently for the performers to appear. The agent, or pretend- ed agent, a mulatto man who gave his name aS Sinith, remained at the door taking money until the audience, becoming impatient, com- menced manifesting restlessness, but no signs of the performers were yet visible. Finally, Mr. Jerome T. Johnson, one of the trustees of the church, walked down the aisle, and mount- ‘ing the stand, stated that he had a disagree- able fact to announce—namely, that the agent had jumped away with the funds, and he had further ascertained that the Fisk troupe were now in Europe. The plaintiff put up a furnace in the house of defendant, and filed @ mechanic's lien on the premises to secure him, and in the ecourt,below it was held that Such work was not properly the subject of fien. Curtis, alias Richardson, alias Hough- ton, charged with having, on the 4th of March, 18/7, committed a rape on the person of Miss Ella Tydings, an orphan girl of Baltimore, in a room at the National Hotel in this city, was called. Curtis, it will be remembered, a few weeks ago was tried and convic on a motion for a new trial, on the ground of miseonduet of the jury, in that a portion of them had_ carried to their room a newspaper, from which evidence was read, the verdict Was set aside and a new trialawarded. In an- ticipation of the trial proceeding to-day, there ted, but was a large number of interested spectators present in the court room this morning, and there were also a number of Baltimoreans (some of them witnesses) in and about the building. The prisoner was brought i court at the usual hour, in company with Ni olas Johnson, the Greek candy vender, charg. ed witha similar offence committed’ on the son of a child of eight years, named Fine- bars. Curtis took a seat near his counsel— Messrs. Cook and Corkhill. CURTIS WANTS A POSTPONEMENT. The court having announced that he was ready to proceed with the case, The defence submitted an afMdavit and a motion for a continuance on the ground of the absence of material witnesses—among them E. pismmersiey, James Gorsuch, May Miller and others, who would hepage ood to the bad character of the prosecuting witnesses before the alleged offence was committed. Mr. Wells replied that this assault of the de- fence on the girl not less cruel than the assault which is the Subject of the indictment. Mr. Cook warmly defended the affidavit, and said that the information he had, by letters and otherwise, sustained the affidavit, and if unfortunate in obiaining the presence of these witnesses he would, in a week or ten days, ioceoe and do the best he could without em. THE COURT REFUSES TO GRANT CONTINUANCE. The court read the affidavit and remarked that on the former trial the court with some hesitation allowed evidence as to individual acts of lewdness prior to the occurrence, and refused it as to such acts since. He had reconsidered his action and examined the law and he would rule that such acts could not be provedeither before or after the act in question, Ye read from Phillips, Starkey, and Greenleaf and said that he now thought he was in error on the former trial. Under the authorities noted the general character could be given. The question was now as to continuing the case So as to afford oppot reunite to eall witnes- ses as to general char: rv. He did not think he affidavit, was suflicient for the general acter is that which is known by ail in a hborhood, and one of her acquaintance is good as another. In this affidavit there is a statement repeated in two places. “There are no other witnesses known to the affiant by which he can prove said facts.” Well, there are two witnesses who are expected to prove her general character is bad, and there are no other witnesses by which they can prove the general character so that he did not think this afidavit suffeient, and declined to grant the continuance. 1 + WITNESSES. ™M The defence asked that the witnesses be called, and several failed to answer, when the defence said that they would file a motion for a continuance on the ground of the absence of material witnesses. The Court directed what the jurors be sworn on their roire dire. Mr. Cook.—In the name of justice I demand an opportunity of obtaining the attendance of these witnesses. The Court.—You can have attachments. Mr. Cook then said he would P ‘otest, but at the suggestion of the court said he would ex- cept to the ruling. AFTER A JURY. Mr. G. D, Livingston was sworn, and the de- fence proposed to profound questions as to the qualifications of the jury, but was over- ruled by the court. The defence then ob- jected to the form of the oath but was again overruled, and an exception taken. Mr. Li- vingston and the other juross were called and each answered that they, had formed or ex- pressed an opinion except Mr. L. A. Dent. The marshal was directed to suminion thirty- five talesmen. The following of the talesmen were decided competent by the court: Elisha P. Taylor, Lewis H. Butler, Horace Hineline, John T. Bell, J. A. Stephenson, Alfred Lowry, Jacob Vonderlehr, Z.Whitemore, Daniel M. Good- acre, H.C. McCauley, N. A. Smith, and took seats in the box, with L. Addison Dent, of the regular panel. The defence challenged from this set Messrs. Dent, Butler, Bell, Vonder- lehr and Scephenson. ’W. T. Solomons, B. Berry, Alex. Douglass, John White Thomas Moreland and Henry Heffner, were called and accepted vy the court as competent. Andrew Archer and George Wright had formed opia- jons. Of this number John White was chal- lenged by defence, and Mr. Moreland by the government. John Gral was called and excused, having been on the grand jury which ae the case, and A. W.
