The prisoner, Cephas Jones, was P'aced on the stand, and testified as follows: “My age is twenty-three; have livedin this city nine- teen years; lived on 3d, between B and C streets southwest, last fall; was working at hod-carrying on Shermaa’s row: quit work at 12 noon that day, and went to Mrs. Norton’s at half past: did not stay there long: went home afterwards; it was eight or ten squares away; stayed till about three or four o'clock, when F returned to Norton's, where I had an ment to gointo the country with Em Maggie Norton; got back to Norton's al 4.50; stayed round there till a crowd was around the building ; only went out once, and that was to et @ glass of water ; returned that moment and stayed there till Mrs, Norton said they were going to arrest every ‘man in the row; en going out meta crowd goin, the alley with a lamp; went to Maria Butler's and had only been ina few minutes when the officers came ; Mr. Smith came in with a pistol in his hand, passed me, and went to Butler, asking how long he had been there, and he replied since five o'clock. McLeod, a countryman from Virginia, civ ing his check for $100 on Riggs bank. Fitz. hugh left Gheen & Osborne's stable where the transaction took place, taking the horse with him, and McLeod immediately presented the cheek for payment, and was told that no such depositor was known as Fitzhugh. MeLeod becoming alarmed, reported the case to De- tectives Clarvoe and Voss, who started out for their man, but before they had_ proceeded far, Fitzhugh, fearing arrest and punishment. re- turned the horse by a colored man, to whom he paid ten cents to deliver him to the owner.
