Since he belonged to that sort who carry their hearts on their sleeve, and particularly outspoken in re posed to be thick-set, bis physique hor of that chubby, wiry, broad-shouldered sort that would stand a great amount of hard- ship. His hair was bla and his eye a sort of ndeseribable color, perhaps a cross between a zray and a green—an eye once seen never to be forgotten—not from any extraordinary bailllancy: or flash it contained so much as an oddity that was peculiarly its own. In Victor Emmanuel last quality, always so perceptible in his house, took a’ shape that made the fortune alike of his dynasty and of Italy. When,after the dark day of Novara, he ascended the throne, his subjects expected in the sullenly brave prince, so deeply connected with the Austrian house, an Italian Hapsburg, a thor- ough reactionary, and in part they were not deceived. No man had more of the feeling of kingship or the pride of birth than Victor Emmanuel, and no man more confidence in his own right to rule. He compelled his parliament to sign the peace which saved Piedmont: he quarreled in the very crisis of his fate with Cavour, _ be. cause the ‘at minister made a remark which the King considered derogatory to his house; he refused the throne of the Penin- sula, if he were to be called ‘* King of the Ital- ians;” and he would often aver to the last th it was ‘hard work to guide his political team. He was, in fact, by temperament a King of the old type, but he had acquired, either from some teachings of his father, or the circum. stances of his own history, an absolute con viction that to carry his father’s policy to sue - cess, and rear the threne his father had de- signed, he must be a constitutional King, and from that resolve he never swerved. The trial of the celebrated Kirby will case came to an abrupt termination monday coun- sel forthe defendants stating that they did not desire to offer evidence, but were satisfied that the case should Re, to the jury on the testi- mony of the plaintiffs. Mr. Kirby was an eccentric millionaire, who died two or three years ago, leaving a will which provided for three sets of children in addition to those bearing his own name. His heirs, among whom are the wives of Donn Piatt and Con. gressman Banning, contested the will on the ground that the persons whose paternity he acknowledged were not in reality his child- ren. The testimony on their side, which has been in progress two weeks, has been intended to prove that the “‘old man” was the victim of three designing women, with whom he was on terms of intimacy, and that they used their power over him for thar own aggrandize- ment, making him believ@he was the father of their children, when he was not. It was shown that one of the women purchased an infant to deceive her aged paramour, and that this child was one of those who figured in the will; further, that another woman, who has lived some years in Iowa, induced him to make lega- cies to children that had never been born. The trial has attracted a great deal of atten- tion on account of its peculiar features and the prominence of the parties engaged in it. The unexpected move of the counsel for the defendants Monday is understood to be a device for securing a second trial in the dis- trict court, where they will have the advan- tage of knowing the full strength of their * ponents’ evidence without disclosing their own. The jury ata late hour Monday night reported their inability to agree, and were discharged till next day. STRANGER THAN FICTION—A Sane Woman Caged in a Lunatic Asylum by Her Family in Order to Secure Her Money.—The ingalty into the mental condition of Miss Susan Dick- ie, the alleged lunatic heiress, was concluded in New York last Saturday afternoon. Miss Dickie is now about 45. She was placed in the Bloomin; le asylum in 1871 at the instance of her father, Patrick Dickie, and with the eonsent and approval of her brothers and sis- ters. Under her father's will, Miss Dickie in- herited an inceme of $150,000, the principal of which, in default of lawful issue, was to be di- vided equally among her brothers and sisters. Mr. Delafied summed up last Saturday, on behalf of his client, reviewing the testimony minutely and claiming a conspiracy on the artof her unnatural relatives, aided by the lather, who, at the time of her incarceration, suffered from softening of the brain.
