The officers of sich an organization would be aificers of the cerporation and not of the United States, and could not by any reasonable struction of the 2d section of artic of the constitution be brought within its meaning. Thet section provides that the President “shat! nominate, and by and with the advice and consent of the Senate, shail appoint ambassadors, other puilie ministers and consuls, jadges of the Supreme Court, and all other ifwers +f the United States whose appointments are not herein otherwise pro- vided for, and which shall be established by law. The officers contemplated in the pro- posed act are officers of a a corpora- ton, whose duties would be purely local, and necessarily limited to affairs of purely local and munictpal concern. The particular of- ficers designated in the article of the censti- tation referred to perform itieal functions connected with administration of the general vernment, and the expression, “all other officers of the United States,” must be construed to mean such officers as shall be required to perform some official duty hav- ing a similar relation to the en gral government and the general public. In the exercise of its power in each of these cases Congress is restrained by the 1 limita- tions upon its authority specified in the first eight articles of amendment to the Constitu- tion, guaranteeing certain rights and immu- nities to the . _ But, except restrictions, specified In the articles referred to, and a few other restrictions in some later amendinents of a similar character, the legis- lative power of Congress over the District of Columbia is unlimited It acts at ail times as the national po wrong bat in dealing with matters that relate to the states it exer- elses @ Pgs of adifferent nature from that which it exercises in dealiug with the terri- ies and the District of Columbia.
