When addressed personally they are regarded as private letters, and fn cases of absence inconvenient delays frequently eccur from that cause. — +20. A Political Crisis Approaching. Frequent reference bas been made in THE Stax to the vital importance of providing some more definite method of counting the electoral vote for President aad Vice Prest- aent. The time nas at last come, as we pre- dicted it would, when both houses of Con- gress must ses the imperative necessity of adoptivg some system by which @ fair and Atisfactory count of the vote can be made by both bouses. The Senate last seasion in- formed the House that the joint rales of the two houses were no longer in force, The twenty-second joint rule, in brief, Provided that, if the two houses disagreed on counting the vote of any state, it should be thrown out. Under this rule the process migbt be kept up until no candidate had a majority of all the electoral votes, in Which case the election would go into the Honse of Representatives. It has recently been intimated that the House will pow con- tend, should Hayes be elected, tnat the joint ules @re still in force. This must be amis- take, for joint rales cannot be such unless agreed to by both houses. This view is sus- tained by the veteran ex journal clerk of the House, John M. Barclay, the author of “ Barciay’s Digest,” whose opinion on all such subjects is regarded as ipfallible by Pe@riiamentarians in both bodies. Under the head of “Joint Rules,” the next edition of she Digest wil! contain the following: “Whenever the two Houses may fail to adopt forthe Congress the joint ralesof a preceding Congress, (which frequently oc curs.) It would seem, under the authority conferred by the Constitution a; eacn House, (Art 1, section 5,) ‘todetermive the rules cf its proceedings,’ tobe the uptoubted right of each House, at'pleasare, to decline further acquiescence in the enforcement of aby one or ail of them. And heres, aitnongh the Jomnt rules @s acquiesced in during the Forty-third Congress, appear fa this ‘Di- , the ‘ollowing proceedings during tne first session of the present Congress would seem to indicate that no joiut rules ara now foree.”” {Here follow the proceedings of the Senate aud House on the subject of joint rules, all of whieh have been recently published | It is then probably safe to assume that Bone of the joint rules are in force, and it therefore follows that elther @ new rule for counting the vote must be adopted or the Constitution alone must be the only guide. in the latter event the question will arise #hall the piain letter of tne Constitution be followed, or will precedent govero? Tne records show (1) that the President of the Seuate has never atiempted to act as a judicial officer In determining the validity of @ state vo e; (2) inal waile such questions have invariably been referred to the two houses of Congress, neither houss bas ever asserted its right to throw out a State Or choose between two sets of returas, except under the twenty-secoad rule, waich Congress has expressly omitted to re adopt; (3) that all disputes of this uatore that have @risen have been decided by the two houses, acting concurrently, though they derived no authority to do so, eller from the constitu- Hon or the laws. On the other hand, let it be supposed for a Moment that the presiding officer of the Senate should entertain tne view that he alone, usder the Constitution, is vested with the sole power of opening and counting the Vote, and should deciine to entertain objec- Uons in regard to counting the voteof any particular state, pointing to that clause of the Constitation which says that after the votes are opened they shall then be counted * The Constitution does not apparently con- template the exigency of au objection to counting the vote of any state, but simply says “the vote shali then be counted.” Itis more reasonable to suppose, however, in the absence of the 224 joint rule, that all questions of this kind arising would be referred to the two houses for coneur- rent action, and that should a majority of of both houses vote agaiuat throwing out the vole of any state, it would not be | », founted by the presiding cfficer. Bat this system would be quite as vicious as that provided by the cefunet 22¢ joint rule, since objections migbt becarrted so tar as to throw the election into the House. {n the event of such @ rule ef action the counting of the Vote Will be attended with imminent dan- gertothe country. The question, the Leiyer thinks, is how much and how far can the perma ment exhibition repeat these ambitious efforts of its Sydenham prototype, and yet avoid its disastrous financial career’ At Sydemham commercial exhibits are quite overshadowed by picture galleries, theatrical performances, aquaria, tllustra- tions of natural history, geology, &>. He was called upon by a large num- gratulations made & speech, which is a model of brevity, containing as it doesoniy paisty-taree words. ‘The Richmond Dispatch is very savage over the statement that General Sherman desired the election of Governor Hayes, and says, “A very unworthy commander of the | pational armies is this General Sherman. He ought to command an army of negroes.’ The general of the army has succeeded in keeping himself pretty weil aloof from poli- | thes since he acceded to his high office, and 80 reticent has he been on that subject that the politicians have been puzzied to know in which party to class him. When asked directly which candidate he preferred and he answered “Hayes,” he probably enter- tained the notion that ne had gs much right to express his preference as other Amer- lean citizen.
