The New York Times, in com- menting on the possible danger attending @ disputed election, says it shoud be remem- bered that wa have never approached the Precise ianger which now my be ahead of us, We have never seen a time when @ con- test on this point would be so complicated, Would awaken such bitter passions, or Would be likely to be more obstinate. Great closeness in the election would make @ con- test, if not probable, at least possible. If bjection shoul be made, next February, to the counting of a sufficient number of votes to prevent either of the candidates receiving & majority, there would instantly arise pre tensions, based on grounds of a certain Plausibility, whieh no human tribunal could decide, and which would have to be dispored of, 1f at all, by 0 incredible de gree of wisdom and forvearance on doin sides. But under the Constitution nothipg what ever is said in regard to objecting to the vote of astate. It simply says “the vote shail be counted. This would seem to be manda tory. The Times supposes, for instance, that the vote of South Carolina la objected to on the ground that United States troops were in the state at the time of the election. The vote of New York mignt also be objected to on the ground of extensive frauds. Tals pro cess might go on until ne! ther candidate had &@ majority of all the votes. when the elec- tion would devolve on the House. Tais Wouk! be the result under the twenty- second joint rule; but this rule, it must be remembered, is no longer tn existence. Tne Provision of the Constitution which takes the place of this rule does say, however, that ip case no candidate is found to have a majority of al) the electoral votes cast the House shal! immediately proceed to elect. ‘Tigs might be construed by som> to imply that the votes of states objected to might be thrown oat, bot the inference would hardly beafairone. Itis held by many, and with ® good sbow of reason, that the presiding officer of the Senate is vested under the Con- stitution with the power of counting such votes as he pleases, and of deciding all ques Uons of procedure as they arise. He might, therefore, rule out of order ali objections to counting the vote of certain states, and in eases where there are two sets of returns Would count whichever one he chose. It is quite provable that when the two houses meet in December they will adopt some system, specific in all its details, by Which the vote can be counted. It is not unlikely that the discussion on this import- ant subject will be prolonged far into the session. Should Hayes beelected by asmali mejority, the democrats would doubtless endeavor to resuscitate rule twenty-two. while the republicans would want a new rule which would preciude the probability of an election by the House. At aoy rate, the Matter must be adjusted before the second Wednesday in February, when both house- meet to count the vote. — The Agricultural: Department ‘Tre Commissioner of Agriculture has just trapsmitted Dis annual report to the Presi- dent; and this reminds us of the erroneous impression that so generally prevails, that the Agricultural Department is a bureau of the Interior. Fourteen years ago, by act of Cougress, it was made an independent “Ex- ecative Department,” and its head required to make bis annual report directly to the President and to Congress. This has not been impressed upon the pubile mind, be- cause the head of the department has not been made a Cabinet officer by any act of Congress.
