To-day, in the Criminal Court, Judge Mac- Artbur, the case of W. H. Ottman, charged with the larceny of $47,097.03 from the Trea- sury in June last, in which the jury failed to agree last week, was called. District Attorney Wells asked that the case be set down for trial on Monday next. Mr. Elliott expresse the hope that the assignment would not be made, and called attention to the fact that the case is now un- der exceptions, which have not been settled. Mr. Merrick said that it would be tmpoasi- ble fer him to co on with the case at the time named, and he understood that there were 400 cases on the calendar awaiting trial. Gov. Wells replied that many of them were | old cases, and there was really about 1) days work for the term outside of these cases. Mr. Merrick urged that there was an ap- peal pending in the Halleck case, and they should wait until that is dig of. Mr. Wells replied that these cases had been pending since August, and every time this trial fs put off it becomes more and | more ditficuit to try. There are 40 witnesses | the government scattered through the try, some of whom may die; and there | Was considerable money locked up in it. The new indictment alleges the conviction of Halleex, and that 1s the only new potnt. Mr. Carpenter suggested that it was no | fault of the defence that the money was locked up; let the government release it. As for the danger of witnesses dying let the government insure their lives.
