Sworm Statement. ‘The attention of the p public is invited to the following figures showing the sworn cir- | culation of THE EVENING STAR on the dates named—a circulation believed by com- petent judges to be fully four times as large | as that of any other daily paper in Washington: A The case of Morsell et al. vs. The First National Bank of Washington, decided by the Supreme Court of the United States on the 20th of last month, is of great practical utility to the legal profession and the com- munity. The unanimous opinion of the court was delivered by Mr. Justice Swayne, nd presents the main question at issue in so clear @ manner as to exclude the possi- bility of doubt tn the fature. The record shows that the appeal was taken by the Washington Co operative Building and De- posit Association from a decree of the Su. preme Court of this District passed in case Of the First National Bank of Washington vs. John W. Morsell, Michael P.C. al., on the following state of facts:—No- vember 4, 1867, Morse!ll purchased certain real property in the city of Washington, and executed a deed of trust to secure the bat- ance of the purchase money, ($10,000.) tober 21, 1, he purchased advances on his stock in the aforesaid buiidiag associa. tion and, to secure the payment of dues, «&e., » in accordance wita the consti- tation of the association, he executed the usual bond and the deed of trust on the same property. January 2%, 1571, the bank obtained judgment against Morsell, and on the 10th of February of the same year Means, Skinner & Co, of Baltimore, obtained Judgment against him, both of the judgments having been rendered by the Supreme Court of the District. March Ist, 11, Morsell executed another deed of trust to securg, the association the Prompt payment of dues, &e. Uader this last trust $1,500 and upwards were due on the 22d of September, Ist}, when the bank Bled a jadgment creditor's bill in equity, making Morsell and the building associa- Uon and its trustees, partiesdefendant. The Property was sold pursuant to a decree of the court upon this bill, and the proceeds, which were not sufficient to pay the ex- penses of sale, the building association debt, and the judgments, were held subject to the further order of the court. auditor (Mr. Walter S. Cox), who, in an elaborate report, sustained the claim of the association to the entire fund, notwithstand- ing & portion was secured by the last deed of trust, which post dated the judgments. The counsel of the judgment creditors excepted to the report of the auditor: Ist. Because it gave priority in payment to the amount | secured by tbe last deed of trust over the judgments. 2d. Because it accorded the | building association “a large sum for exorbi- | tant fines imposed upon and charged against the defendant Morsel!;” and 3d, Because it lowed to the building association unlaw- fal and unreasonable interest for the use of money, £c. The Supreme Court of the Dis- trict in general term (Mr. Justice Wylie dis- senting) decided that the judgments having been rendered aud docketed prior to the recor’ of the last deed of trust should have Priority of payment out of the funds. The bailding association appealed to the Su- preme Court of the United States. Although the common understanding of the law by the profession here, prior to the decision of this case by the District Supreme Court, was that a judgment uid not create a lien upon real property if it was encumbered by deed of trust or mortgage at the time of the rendition of the judgment, yet there had A controversy | over the fand accordingly arose before the | | vance ane of bis own men-of-war, by which vessel he was formally recognized as he en- teres New York harbor, it would have been | ® graceful erongh act in him, and not caleu- | lated to compromise him in his traveling role of gentieman, simply, had he accepted tbe compliment of the escort to New York city by the premier and other members of the American Cabinet, and the first officers | ofourarmy and navy. Butit may be that | bis been no direct adjudication of the point by the Supreme Court of the United States, and hence there was consirerable doubt and un- certainty about it. Many valuable land titles in the District had been passed on the theory that judgments were not liens on an equity of redemption—a right to redeem from an incumbrance—and until the filing of @ judgment creditor's bill to enforce such judgment against the specific property of the debtor thus encumbered, it remained wholly unaffected by all judgments rendered subse- quent to such encumbrances. And so it was in this case. When the judgments were ren- dered, Morsell had no interest in the prop- erty excepting an equity of redemption, having previously encumbered it by deeds Of trust,and it was held by the Supreme Court of the United States thatan equity of redemption in lands in the Maryland part of the District of Columbia, under the com- mon law, which was in force in 1801, thedate Of the cesston, and is yet in force—could not besold under execution against the judgment deptor—that the lien of a judgment here grows out of the right to take property in execution, and where it cannot be so taken there Is no lien until the filing of the bill in equity, whereby a lien ts created dating from the date of filing such bill. This is what is called in law a lis pendens, the lien growing out of the pendency of the suit. Tne Supreme Court says: “The jadgmeats in no Wise affected the trust premises uuill the bill was filed. That created @ lien in favor Of the judgment creditors. There was none before. This was posterior to the execution | of both the deeds of trust in favor of the astociation and to all the advances made under them. The court below was clearly in error In susta@ining the exception to the audi- tor's report, and in giving priority in pay- ment to the jadgments over the amount | secured by the last deed of trast.”” Another important featurein this case is, that notwithstanding the fact that the record disclosed @ building association ac- count fn the asuai form, charging dues on advances, premiums, fines, &c., strictly in conformity with the constitution of the as- Sociation, and although its claim to the | | entire fund was contested by the judgment | creditors, because of “fines,” “exorbitant interest,” &c., &c., yet the Supreme Court of the United States, upon thorough examina- tion Of te whole record, delivered the unani- mous opinion to which we have referred. More than usual interest attaches to this case, because it is the ir in whien the va- lidity of @ ballding association contract, ia the form usually made by our District asso- eiations, has vee. adjudicated by tne Sa- preme Court of the United States. There nas been much discussion and litigation in our District courts on the subject, and their de- cisions have been geverally acquiesced in by the building associations, but although the ‘Amount in issue (about +i ,500) was compara- tively small, the Washington Co operative determined to make &@ test case, ant obtain ® decision from the highest lega! author- ity. Their success will be likely to save much time and litigation in the future, and to place all the eqattabie Schemes of our District building asso- Ciations upon a firm and legal fouada- Mon. The case just decided has veen in the courts about three years, and was conducted by Messrs. R.K. Elliott and J. J.
