Roap.— Yesterday afternoon about 4 o'clock a fatal accident occurred on the Baltimore and Ohio railway, nineteen miies from Baltimore, at a place Enown as Union Dam curve. The Piedmont train, due in Baltimore at 550 p m., was coming east, and a@ freight train was passing west at that point, when a man was seen by the engineer of the former, as he rounded the sharp bend at a rapid rate, standizg as if bewildered on the track upon which the freight train was approaching, with his face directei that Way. He appeared to be unconscions of the nearness of the passenger train, but was en- dcavoring to avoid the freight train. With this purpose, when the locomotive of the passenger train was only a few yards off, he step] juickly from thé track of the freight train to the other, and in an instant he was struck a terrible blow by the cow-catcher of the passenger locomotive, and sent whirling throngh the air a distance of fully twelve feet to the side of the road, where he lay per- fectly motionless and was supposed to be dead. The trains were stop; and the in- jnred man piaced on board the passenger train. life yet being evident. SUPREME Cocrt.— trae f @ decision was an- | nounced in the U. 8. Supreme Court in the | case of Stott et al. vs. Ratherford. Tais was & suil brought on @ lease made by Dr. Gur- | ley and others, representing a church exten- | sion committee. There was a verdict for | the plaintiff at the trial, but the General Term reversed the case and ordered a jadg- meut for the defendant, on the ground that there was no authority for the lease, as it showed upon its face that the committce had no title to the premises. This court reverses that judgment, directing a ponent to be entered u) the verdict holding that every reasonable presumption 1s to cpade in | favor of the validity of the lease, and that there is nothing in the recitals inconsistent with the holding of the legal title by the | committee in trust, to enable them the bet- , ler to discharge their duties towards the | Property of the church. The act done pre- supposes the prior act necessary to give it | Yahdity, and itis a fair inference from the | language used that the lessors had such an estate or tuitle in trast as would warrant the giving of the lease, and would render it valid. According to the view below it is id the lessee could have not only occupied premises without performing his cove- pants, butattheend of the term he could have held possession in defiance of the les- sors. This would be contrary to reason, jus- luce and the law. Mr. Justice Swayne de- livéred the opinion. ——— THE MARKET House Case.— next the decree in Oa Saturday the case of Hoffman et ai. agt. the Washington market company will be submitted to Judge Wyile ta the Equit Court. The crevices had been filled in with wax. But at that time the statue was in position and screwed down. It is asserted that the whole statue is repair- ed in this way, and that it will be full of holes after six months’ exposure. The con- tractors, who would like very well to hang this meddlesome Bonapartist workman, Plead haste as an excuse, ncny. that they ith bronze, now will repair the crevices wi position, Some ot the gnant at this alleged that the statue is in journals are very in: swindle upon the state, the joo having bcon done in the cheapest possible manner.— Paris 68.
