J. Johnson, the examiner to whom was referred the case of the little acrobat, Zan'o Poole, taken about a week since from the custedy of his brothers, at the Theater Comique, commenced the examina‘ion of witnesses yesterday—Mr. F. Miller appear- ing for Mr. Gatchel, to whom the cus 16 the child was awarded by Judge Wylie, aud Mr. L.G. Hine for the brothers of the boy. The only witness who was examined was Mr. Gatchel, and he testified briefly to the facts set forth in the petition, that the child was made to perform feats dangerous to life and limb. This morning Mr. Henry Watson gave bis testimony, very much to the same effect as Mr. Gatchel’s. For the respondent, Mrs. Leipoid and Dennis O’Nea! testified that there was no inhuman treatment to Lhe boy, and the performance was perfectly safe. pensar amon A HABEAS CORPUS FOR A WIFF.—This Morning a petition was filed by Mr. J. & Norris, for Hugh Small, for a writ of bh s corpus forthe production of his wife. Tne petitioner is a young man, and represents that he isdenied the association of his wife (who has an infant child at her breast) by John and Priscilla Harrison, who have her at & house corner of 10th and C streets north- west, and that the wife is desirous to to him but is prevented. The petition was presented to Judge Cartter, who directed the writ to issue, returnable at two o'clock. One of the batliffs of the marshall’s office served the writ at once, and returned with the Info tion that “the girl is now in Canada.” The respondents are gipsies, and the parties—Hugh Small Amey and Har: son—were married about the middle of No vember. NEW RULES. Mr. Worthington submitted new rules re- lating to the duties of trustees and sales. | These rules provide that the rates paid for advertisements shall be per square of four | lines of agate, 75 cents, one time, &c., the same now charged to the public; that the | trustee may append his name to the aver- lace of bu- siness or residence, but shall not enhance the | cost of the advertisement by publishing the | name or card of any person employed to cry the property; that the trustee shall be pres. | ent and receive the deposit required; and | shall state nnder oath whether he has com- plied with all the provisions of the rule; and | the compensation to the crier to be paid by ; the trustee, shall be one-eighth of one per cent., provided that such compensation bo | not less than £10. Judge Olin remarked that the rule as to the fees of trustees should be amended. It Was not right that a trustee should receive sometimes $1,000 for services not worth 225.
