SUPREME CoverT.—Yesterday, in the Supreme Court Of the United States, the two cases of Fran- cis Dainese against the Board of Public Works, m the Supreme Court of the Dis- 4rict of Columbia, were decited; Mr. Justice Miller delivering the opinion of the court, reversing the decrees of the Distriet eourt, with costs, remanding the causes for fur- iner procecdings. In these cases, Dainese commenced the erection of &@ row of bulld- ipgs in the eastern ‘ore of the city, and it ‘Was alleged that the materials used were Brsound and the bulldings unsafe. The Board of Public Works attempted to stop the work and condemn the buildings as a nuisance, and Dainese a for an in- Jjarction, which was refused. Some Important Recommendations. The twelfth annual report of the Board of Fire ‘Commissioners of the District of Co. Commissioners, = po ee 7 ae the new tel Delaware avenue, near C street which is com} ly fitted out, and mirably adapt for the purposes for which it was built. NEEDED REPAIRS TO ENGINES. Extensive ch: and repairs have been made to No. 4 boiler, engine and pamps—the only = needed in five years’ service. Engine No. 5 bas had th repairs. The report says :—*The boilers 1,2and Sare completely worn out by the hard ser- vice they have ed during the past eleven years, and must be replaced by new oves, otherwise the department will only have two reliable steam fire engines in ser- vice. This is a very serious matter for. your consideration, and unless immediate atten- tion is given it, the results may be disas- trous. These botlers have been repaired from time to time, but cannot be depended on for duty, and ranst be discarded.” OTHER APPARATUS. The running gear has been kept in that first-class condition so necessary. Printy's automatic relief valves and shut of nozzles have been placed in use with ail the enzines and have proved servicable by resacing damage from water. Heaters which keep the water in the boilers at boiling point have been piaced on engines 1, 2, 4. and 5, reduc- ing the time required to put them in use, and new suction sleeves have been placed on all the engines. The hose carriages require no considerable repairs. There are two old style hook and jadder trucks in use which run toal!l fires in the District, aad conse- quently constant repairs have been neces- sary to keep them in service. The track is &@ most valuable piece of apparatus, and is required in nearly every case of fire. Eight borses baye been purchased during the year, and with few exceptions the stock of the de- rtment is in good condition. No new hose as been purchased, but a considerable quan- tity is required in addition to that on hand. DANGEROUS. They call “attention to the storage of large quantities of gaseous oils and alcoholic Li- quors in the business sections and densely inbabited parts of the District, in utter dis- regard for the safety of property. Also to the frequent alarms of fire oceasioned by ac- cidents from the use of coal oil. The low rice at which an inferior quality of coal oil is furnished is a Ee to the poor es- pecially to use it. Many careless ns purehase it, and the result is a constant re- currence of conflagrations aud frequent losses of life. Some stringent law regarding these matters should be enacted.” TWO NEW PIRE COMPANIES AND ANOTHER TRUCK COMPANY NEEDED. The fire commissioners state that they Wonld be derelict in their duty did they not earnestly urge that two additional engine companies be completely equipped for ser- viee—one in the northern and the other in the northeastern section of the city, and that an additional hook and ladder company be equipped with the best modern improved ap- paratus, in the western partof the city. In support of these recommendations they call attention to “the vastly increased limits of the improved portions of the District within the past eight years and the considerable bum of rows of houses erected aud in course of erection, with MANSARD ROOFS, which are not only very dangerous in char- acter, but have heretofore been almost un- known in this District. With the increased needs of the District no addition has been made to the number of engines, but on the other hand there are not so many in service as formerly. Eight years ago, in addition to our present force, the government steam fire engines responded to alarms with their ap- ese and aided to extinguish the fires. experience here and in other cities shows the aprog d of having a full, at least a suf- ficient fire force to provide protection not only — small fires but extensive con- flagrations. With our present force we could pot — with such an emergency as two fires widely distant occurring simultane- ously, or the one immediately succeeding the other; or a large fire in a thickly built portion of the District during a heavy storm of wind. THE ACCOMPANYING REPORTS. The board note the fact that the report of the Chief Engineer shows the number of Gres to have been greater than that of last year and the losses less, affordin: possible proof of the efficiency of the officers and men. Also endorse the report of the Superintendent of the fire alarm, showin; that the new automatic apparatus (plac in service September 2th) readers excsjlent service and is perfect in its appointments, and also endorse his recommendation fur an &@dditional operator. ESTIMATES. The board subroit estimates for the year ending June 30th, 1877, as follows:—Salaries, 354,733; rebuilding steamers 1, 2 and 3, 39 000; repairs to other ae, 83,000; rebuild- ing No. 2 house, $10,000; repairs to oth bouses, $2,500; horse feed, miscellaneous, $3,500; fuel and $2,500; barness and penses couplings, $12, estimates for the = engine and one hook-and-lad- footing 83,17: THE REPORT OF CHIEF ENGINEER MARTIN 1 CRONIN shows:—Number of alarms, 158-15 false, 8 for brow gerpan test and 133 for fires that in- volved a total alls loss of 267,900, with an insurance of $39, shows an increase Sonmperal ri fs ated ihe eB com average of the 2 years, of 32. Appended is a statement showing the num- ber of fires and losses for the past eleven years, averaging 95 fires and $141,945 per year. THE REPORT OF THE SUPERINTENDENT OF THE FIRE ALARM TELEGRAPH (Mr. H.R. Miles) heapeenaes. He states that the total cost of maintaining the telegraph, exclusive of the salaries paid its commis- sioned officers, has not been 22,000, but does not include fitting up the new office or taking down the old wire, but only the legitimate expense of repairs, maintaining batteries, «&e. For the ensuing year, owing to the in- creased amount of batiery, (about four-fold.) and fully double the quantity of wire to ba kept in’ repair, $3,000 will be required. Smith to receive and disburse the moneys of the company in place of a treasurer under bond; in assuming to sell the stalls and stands for term of two terms, with the rigit to re- sell, in June, 1872, June, 1874, and June, 1875, which he charges was in violation of the trust rej in them, in violation of the act of gress and in of the rights of the stockholders; and in excess of of their power in April, 1872, erroneously as- suming to establish a schedule of rents ia a manner other than that provided by law, by which they involved the company in vexa- tious and expensive law suits; that in disre- = of their duty =, entered into an un- awful agreement with the late Governor and Board of Public Works, whereby a large and valuable tract of land granted for the purposes of a public market was wholly abandoned and surrendered, thus destroying in part the franchise; that by reason of this misconduct the company has been involved in large indebtedness—s200,000 or upwards— which is evidenced by bonds issued merely to postpone the immediate collection of the indebtedness by the creditors, and according to his information and belief the company has no means to pay its indebtedness other than the franchise and buildings which are not sufficient to pay off the indebtedness. dhe also chi that with intent to avoid inquiry into the affairs of the com- pany, and to impose upon Congress, the Stockholders and the public, they are ex- pending a large sum of money—330,000, or Uhereabouts—on the erection of towers or gables on the northern front of the buildings, Which is useless ornamentation, and the money for the same has been or will be bor- row: to pay for the same; but the exact Amount he cannot asceriain, because the officers bave refused to allow him to inspect the books. He also charges that they have neglected and refused to pay certain taxes and assessments levied on the proper: Which assessments carry heavy interest constitute a lien on the property, rende the property liable to sale. Also, that bs their mismanagement and abuses of trust they have involved the cor- tion in large indebtedness, ant multitude of jaw suits with dealers, and have failed to collect a reasonable ani proper rental of the stalls, but, by reason of the abuses, they have been unadie to collect even @ small percentage of the amount claimed, and have wasted and squ the revenues in useless and expens: F tiou instituted or caused by the aforesaid violations of law and abuses on the part of the directors untsl the company is unable to meet its obligations. Rev. David Wills occupied the chair as moderator and Dr. B. F. Bittinger acted as clerk. All present not connectei with the Presbytery were, on motion of Dr. or nigga invir to participate in the ex- ercises. Rev. Dr. Chester addressed the meeting on the subject of the duties imposed upon the elders. By their united effort they might awake a spirit of fraternal intercourse be- tween the members of the different churches; develop and illustrate the communion of faints, stir up the minds of one another toa sense of their responsibilities and privileges, and by united prayer prevail with God for an outpouring of bis spirit. Under the care of the Presbytery they have 3,499 members, of which 2,400 are in this city. Rev. This was on action ht to recover damages for being put off a car and assaulied by a conductor, who by kicking the plaints broke two of the plaintiff's ribs for which $10,000 are claimed. It was claimed by plaintiff that he got in a 1th street car and handed his transfer to the con- ductor, and subsequently went to the front latform when the fare was , and place P refusing to pay a controversy took and he was knocked off by the coaductor. Yesterday, Lawrence Bird, charged with assault and battery with intent to Kill and robbery of John Pingel, was found guilty of assault and robbery and sentenci to four years in the penitentiary.
