On Wednesday last, Gen. Egbert L. Viele read a paper on the im- portant subject of city drainage and water Supply. He took the ground that no house is absolutely free from the contamination of wewer gases, and asserted that “‘no trap or other contrivance has yet been invented to prevent the gases of an unventilated sewer from penetrating into the houses along its route.” Healso believed that “there is not one man in ten thousand who can tell whe- ther or not the soil-pipe of his residenee has @ trap connecting it with the street sewer, nor is there one instance in a thousand where such a trap is inexistence.” The ventilation Of sewers ought to be secured in some way, either by the leaders of houses, or by special conduits connected with the exterior of pub- lie buildings. In June last a Mr. Michels took a book wei ng tweaty- one and a half ounces, and affixed to which Were stamps amounting in value to eleven cents to the post office for transmission through the mails to Philadelphia. The ease came up on Wed- nesday for argument, when counsel for Mr. Michels claimed that the eleven cents post- age which had been affixed to the package Was sufficient to carry itunder the act of June Sd, 1574, (the old Jaw;) and that the amendment cf this act was unconstitution- al, inasmuch as it was a revenue measure, and should have originated in the House of Representatives instead of the Senate. The United States statute, he said, provided that all bills for raising the revenue shall origin- ate In the House of Representatives, bat the Senate may propose or concur with the amer S, As on other bills. Assistant United States District Attorney Tremain argued that the court had no jurisdiction, both parties to the suit being residents of the same state, and this not being a case arising under the constitution or laws of the Uaited States. He further held that outside of the IMstrict of Columbia, the cireyit courts have no power to grant a mandamus as aa origi- nal writ. He also held that a mandamus ‘was not the proper remedy tu an action for damages against the postmaster. Tne court reserved its decision.
