Recess. —_o—__—_. A BUILDING ASSOCIATION CASE.— Yester- day the defendants in the case of W. H. Cot- ton against Cross and Bacon, trustees of the National Union Building Association, filed an answer by Mr. P. F. Larner. The bill was filed through W.T. Johnson for an injunc- tion, and, among other things, charged that the National Union Building Association No.2 has closed. The answer deuies that the association has closed, and quotes: “The association shall continue until the stock is Worth fifty per cent. premium, and shall then proceed to close, and each stockholder Shall receive a pro rata share oi profits on all shares upon which no advance has been made.” They state that they stil! hold their official position though the association has ceased to hold their usual monthly meet- ings, that it has not closed, because it has pot as yet realized the requisite funds to liquidate stock at present outstanding and uncanceled. They charge that the reason why ssid association has been unable to close up has been owing to the fact that the association has veen embarrassed by the wrongful acts of its former secretary, one Wm. T. Johpson, who has in various illegal ways deprived the association of the use of fonds properly belonging to it. They aver that Cotton is indebted to the association SIM, according to the books of the former secretary, Johnson, and if other payments bave been made by him they were weroug fully made to Johnson.
