Wetherby secord. ss Board of Health. A BUCGY BILL DISCUSSED—ONE WEEK'S WORK OF THE HEALTH OFFICER. The Board of Health met last night and the treasurer submitted a bill of Mr. Andrew J. loyee for the repair of a buggy belonging to the health officer, amounting to 394.50. He explained that the poundsmaster had been making use of this baggy. his own having | given out, and the health officer's buggy was the only vebicle which he could make use of in the execution of his duty. DR. VERDI OBJECTS. Dr. Verdi was opposed to the payment of | the bill; they pay the health officer 2.500 por annum, much more than any other officer is receiving, because he had to keep a buggy for the use of his office. First, the Board of Health gave him $2,500 his solicitation increased boggy is worn out, let him replace it with another. The board has no right to pay this bil. On the day in question he was at home at 10 o'clock; left and returned again at 11:30 o'clock. His habits are very regular. Captain Cobangh, of the Treasury watch, testified that Prentiss is employed as a Watehman under him; he came tighly re commended and has conducted himself as a gentieman. !Prentiss usually came on duty about 3 o'clock. Several little girls testified to a man on Monday making an indecent exposure be- fore them, as they were on their way to scnool in the Congregational chureh. Ser- geant Perry testified that on Monday, be- tween 12 aiid 1 o'clock. some little girls came tp and sald they had been insnited by some man, who hed gone down Sth street, and he went after him, the gir! ribing him as a wan dressed in a brown pat, Hight pants, and light bat. Near the eorner of 8th and I treets saw the prisoner, who acted suspie- nsiy, and he arrested him. eutenant Eckloff testitied that on Mon- day after the girls had come in and made thé complaint he detained them there until the person was near enough to be identified. They became much excited when they saw him, and afier each of them had said that he was the man he allowed them to leave. Wit ness informed him of the charge, and he said be could refer to Mr. Murtagh and Jadge Edmunds. When witness asked his occupa lon he refused to give it, and finally sald that he was a watchman. For the defendant, Dr. Root, of Kansas, Was called, and testified to tie good cnarac- ter of the accused, even from boyhood. Mr. Erowne proposed to read a number of letters from the governor of Kansas, but the court ruled that it was unnecessary, as a good character had been proved by living witnesses. THE ARGUMENT. Mr. Browne proceeded to argue that the testimony of the government Was absurd, when the character of the accused is consid- ered, and that it was impossible for him to be guilty of the charge; he was too good a moan for that. Mr. Lipscomb, for the government, made some very pertinent remarks in reply as to the demoralizing influences of these acts. THE SENTENCE. The court tmposed @ fine of $50,or ninety days in the workhouse, in one case, and S100 or binety days In the other, remarking that t was not possible that’ those innocent school girls would come up and testify as Ubey had upless they were sure that the nan bad been guilty. An appeal was taken, and bonds fixed at $200 in each case. Ex-Senator Pomeroy was received as surety for his appearance. ——_o—_— The Powers of the Police. A DIFFERENCE OF OPINION BETWE JUDGE SNELL AND ATTORNEY C00} It will be remembered that on October 9th, Judge Snell, of the Police Court, made the following order: “It is ordered, that here- after, in all cases within the original and exclusive jurisdiction of this court, that is to say, in ail simple assaults aud batteries, and all other misdemeanors pot punish: ble by imprisonment in the penitentiary, and in all ofienses against the laws and ordinances of the District in force therein, process shall be directed to the major of tue police; but in cases cognizable in the Supreme Coart, pro- cess shall be directed to the marshal, exce pt in cases of emergency, when it may be di- rected to the msjor of police.” Subsequently Major Richards, superinten dent of police, called on Mr. W. A. Cook, at- torney of the rd, and requesicl’ an opinion on THE FOLLOWING QUESTIO: ist. Can a police officer justify an arrest made under a warrant issued to the marshal of the United States in this District; and 2u, Can process be legally directed out of the Police Court in any United States cases to the major of police and be properly served by him except in cases of “emergency.” MR. COOK SAYS “NO” TO BOTH QUESTIONS. Cook answers both questioas in the negative, and says: ist. No one except the 01 x to whom a warrant is addressed or who may be properly deputized to act in place of such officer can have a right to make an arrest under it. There is, therefore, no authority of law for the service of a war- rant addressed to the marshal by a police officer. Such service would be illegal and would render the police officer executing liable to action for damages. 2d. Sections 1065 and 1066 of the Revi: Code relates to the service of process issued in the Police Court. The first of these sections plainly poke: that in cases arising outof viola- cy.” Hence in cases of offences United States no authority whatever exists to issue to the “major of ce,” aud when an act of Congress designates the class of cases in which process may be issued to a cular officer is it for any court by confer the power. The law makers having Witbheld it no other body can confer it. In various parts of the act in relation to the Police Court the distinetioa between the duties of the District officers proper and those of the United States are clearly indi- cated. In sections 1049 the jurisdiction of the court is declared tn reference to cases against the United States and against the District; in “= psc 1069 oe wi — distinction is mainta’ requiring the prosecution of 1 st the United States to be conducted by the United States Attorney or some of his assistants and prosecution of offences against the District by its attorney Or assistants, and thedistinction is continued in 1079 which provides that fines and penal- ties shall be collected by the marshal or major of police as the case may be.
