Scott, president of Pennsylvania railroad company; Mr. Frank Thompson, general manager of the Baltimore and Potomae, and other officials of the road, had an interview With the District Commissions as to the oc- cupancy of Maryland avenue by the road | the adjacent ground for a freight depot | and coal depot. The freight depot was found to be well advanced. The tracks at that | point was to be arranged so that when the grading is done there will be less cause for complaint than there has been. Judge McArthur called for the reading of the crime of felony and grand larceny Which was read by Mr. Cook. The other in- dictments were also read and the statute under which the last indictrnent is found, section Revised Statutes, (page 1 ») which prescribes a punishment of fine not exceeding $5,000, or imprisonment not ex- ceeding seven years. Mr. Cook explained that although this last indictment was a single one, yet similar in- dictmeuts bad been found against the others. This kind of practice, said Mr. Cook, “is like the Irishman’s toe; nothing like It in the Heaven's above or the earth beneath.” He read authorities to the effect that but one indictment can be found for one offence, reading from ist Wharton's Criminal Law, Sections 424 and 426, He claimed that no perion should be twice put in jeopardy for the same offence or be subject to more than one indictment. This was the same trans- action earved out into several indictments; the same intent goes through all these | charges, viz: the release of Snyder. After referring to the scope of the information he said that there was no extraordinary cutting up of the offence. The indictment for accessory could not be tried until the principal is tried and convicted. They were asked to elect if | _ try him on this indictment, which is impossible. He read from Bishop’s Criminal Procedure, sec. 444, that each count charges @ different offence. He would be obliged to him if the gentlemen on the other side would refer to a case where the govern- men had been required to elect at the outset. Mr. Merrick—1 will refer you to one—a disenssion by the Supreme ‘Court of the Mr. Wells read from Bishop’s Common Law, sec. 1,062, that a man be char, and tried for two offences on the same indict- ment. tHe asked if this was the case as to one indictment why he could not charge the offences in more than one indictment. As to double charging he would say that the re- cords of the court showed a most remarkable ease, (Sth Cranch)—a party charged with Stealiug five articles. THE SAPE BURGLARY CASE. Mr. Wells.—My attention is called to a case fresh in the recollection of some |g men here. and likely to remain fresh in the —- of @ great many people of this Dis- triet—the case of Benton and Miles, the dividnals who robbed the safe of the District Attorney. There are ten indictments in that case against the same individual for robbing the same identical safe on the same identical night. ‘Str, Riddle.—Notwithstanding all that we failed toget him. = roses brother endeavored hard to get him. Mr. Riddle—tIf they had let me alone I would have gotten him. Mr. Wells.—Perhaps some of the others of us may 4 to get him. Mr. Cook.—Sufficient unto the day is the evil thereof.” Mr. Wells.—We do not think these things an evil. We think ita blessed thing to catch rascals and convict them. Mr. Cook.— Make haste. Mr. Riddle, afteran intimation of the court that the indictments were properly drawn, urged that it was the intention which was involved. and said it was astonishing to him that these men were to be tried for three say- eral offences committed at one time. Dr. Verdi, from the committee on inspec- ton of food, to whom was recommitted te report on food of October sth, reported that they find nething in said report reflecting upon the ability of the present inspectors of food. But to avoid ambiguity or misconstruc- tion, the cormittee takes pleasure in stating that the inspectors have,on all oceasion=, performed their duty intelligently and cfi ciently, and that the want of qualifications spoken of in said report refers to the proposed plan of inspecting food in the sefentifie man- her of anulysists nicrosenpists, and not to the valuable practical service rendered by them heretofore. The report was adopted. VITAL STATISTICS. The report of the registra'ton of vital sta. tistics for the week ending October Ith was submitted, showing deaths 76 (2 more than the previous week), of which 31 were whites and 42colored. There were 14 from consump tion (10 colored), 7 pneumonia, 3 by bronent- tis. 4 diarrneea, 5 typhoid fever, i age, 4 infantile convulsions. There were 35 males and 41 females, 34 adults and 42 minors (30 being under 4 years, att of these 22 were col ored.) There were 20 marriages and 7+ births (44 whites and 90 colored.) The rate of mor- tality of the white population was 1527 per 1001 per annum, while the mortallty of fhe colored population was 48.53 per 1,000 for the same period.
