The legislature last year, notwithstanding this provision, passed a license law, and the supreme court Of the state has decided it constitutional, on the ground that the levying of a tax on the liquor business Is not licensing it—a some what startling paradox. The law in ques- lon requires wholesale dea'ers of distilled liquors to pay an annual license (or “tax,” as the court interprets it.) of $300. Retail dealers pay $150; wholesale dealers in malt liquors pay £100, and retail dealers 240. Dis- lillers of spirituous liquors pay $300, and brewers from £50 to $200, according to pro- duct.
