The Baltimore Sun in reviewing the decision which, as was Stated in Tue STAR yestertay, was adverse to the company, says it rests exclusively on the ground of the constitutional right of the State to reserve to itself any proportion of the revenues of the road, chartered by itself, whether derived from the transportati passengers of goods. That !s tos claimed one-fifth of the receipts of passenger fares and the United St s Supreme Court &ffirms the validity of such demand. The right of the states to build roals ani charter roads, and to charge ani to anthorize others to charge what tolls they please, and to an- nex what conditions they please to the grant of such charters is affirmed the broa test terms. Should such exactions become so onerous 4s to interfere with inter-sta com- munication Congress woull have an un- doubted right to interfere unter the constitu- tional authority given that body to rez commerce, estabiish post and military ec. The practical value of the de the treasury of the state may be roughly es- timated in round numbers as at least one- half million of dollars. It covers not only the balance claimed tobe due by the state ap to January 1, 1870, but one-fifth of all the passenger fares collected over the Washing- ton branch since that time, for which other suits have been brought by the state, and for the exact ascertainment of which, both prior and subsequent to 1370, a bill for an account bas been filed in equity. Having been defeate] in the courts, thé railroad company will probably appeal to the legistature for relief, that body being now the only souree from which relief can ascas Why the law imposing this tax shoul be re- pealed; the first of which is that it is paid not by the railroad company, but by the pas- sengers, who are made up of persons from all Sections of the Union. The courts have de- cided that the tax is not technically a “capi- tation tax,” but it virtuaily amounts to that since the one-fifth tribute must be exacted by the company from every person passing over the road. The state has laid no such burden on the other line connecting Balti- more and Washington, and to continue the imposition m the ease of the Baltimore and Obio certainly looks like an unfair diserimi- nation. es The Charleston (S.
