Dyer was charged with forgery of the name of William Lowe on the back 6f # promissory note of one hundred dollars, awn and signed by one J. H. Rollins, pay- r of said Lowe, with intent to defraud the said Lowe. The note in question was produced and shown to Mr. Lowe, who denied that he had ever signed it. J. HF lus was shown the note and testified that he signed his name on the face of it in the presence of Mr. Eastwoot, at Dyer’ Mr. B.C. D: of Thomas C. Dyer, testified that Mr. Lowe told him that he had endorsed the notes; he (Witness) saw him writing at the counter on small pieces of paper which had the appearance of being notes. Lowe had been drinking quite frecly. Mr. ert, bar- keeper, testified that Lawe drank some eignt times and was quite lively.
