DROPPED Dr IN THE STREET FROM PNEUMONIA.—Last night, a colored man aged about 45 years, suddenly fell on the street in the Sixth Ward, and before medical aid was obtained he expired. Sergeant Hol linberger had the body removed to the eizhth tinct station. It is not a very clear case in my ownmind. There is a distinction, however, between murder and maasiaughter, and in a ease where it is doubtful whether the offenee was the one or the other, the inclination of the law would be to give the defendant the benefit of that doubt. The sury in that case returned a verdict of guilty of murder. after devoting a consider- able period to the consideration, and no doubt arrived at their conclusion conscientiously and with reluctance, so that there is no dis- paragement upon their conduct in the views which are now being expressed by myself. With these views of the case, therefore, I give the concurrence of the court to the course which is now to be taken, and I shall therefore permit the defendant to Withdraw his plea of not guilty, and to inter- pose one in the qualified form which is now proposed. THE PLEA CHANGED. The court asked Slatter to step forward, and he did so. The court said that on the in- dietment for murder he had plead not guilty, -_ asked fhe now desired to change that en. ithe prisoner.—“I withdraw the plea of not guilty and enter one of guilty of manslaugh- ter, sir.” Mr. Riddle asked that the rendition of the Judgment of the court bedelayed, to give the defendant time to settle bs some business affairs, and also to enable the counsel to pre- sent some evidence as to his previous good character. Judge Fisher objected, and stated that if evidence was to be taken as to his good character he desired to present evidence as to the reverse. JUDGEMENT ON MONDAY WEEK. After some discussion, the court said that the judgment would be rendered on Monday, 29th instant. The prisoner's wife was in the room, and Was much affected.
