He was imtreduced, and after returning thanke for the invitation to him a Jew, to speak in behalf of people, he referred to'the Pereecution of the Jews in various countries of Earope daring the middle ages, and down almost to the present 4 and to the obloquy ieaped upon them, not oni: by the ignorant and bigoted, but even by suc writers as Shakspeare and Dickens. who, in iy leck and Fogin, bold them up to ridicule. So far as comment is con- cerned upon the conduct of the judge who now . it may be made; it will not be mter- fered with by me, but so far as the jury is con cerned, it is my sworn duty to see that they shall not be interfered witb, nor shall the proceed- We can con trol, so far asthe former 18 concerned, to the Precincts of the courts, by this summary pro- cess, and it is not so certain that the summary process may not be used in regard to the in’ ference by publication. Suppose that whilst this jury was being formed, and atter it was formed, that some man had stepped in tne court-room doer and announced, “that is a packed jury,” within the hearing of the court, does anybody suppose they could not have been instantly dealt with summarily, as long as the contempt remained unpurged’ Now, what difference is there in that declaration’ being made, and it being published where it is ex- pected that the publte will read the pay My impression is, and J say it in all _kindaess, and I eay it with a view of bringing to the attention of persons what I think they have omitted to notice in the provisions of the law, if this court is to be held as a United States court, under the provisions of the acts of Congress, parties who do this may be punished. It it is to be held as not only having the jaris- diction of @ Umited States court, bat aiso the jurtediction which attaches from the state ot Maryland, then clearly the punishment could be more summ Now, combine the two, then, as ts probable; why, then, if you take it as under the act of Uongress, the two acts, one which limits the power of a court, passed years #g0, a8 applicable to the punishment for con- tempt of that which occurred either in the presence of the court, or so near thereto as to interfere with the progress of a trial, that bas been supplied by # very recent act of Congress. I do not mean the act which has been denomin- ated by the pnblic as the “gag law;” but I mean snother, In 1812 Congress passed’ an act—An- gust, 1872—and Judge Fieid called the attention of the grand jury of California, in bis charge to the grand jury, in this language: . * At its last session Congress passed a strin- gent act to prevent the continuance of a per- nicious practice, as well as to prevent any attempt to iniiuence the administration of jus- tice corruptly or by the intimidation of jurors. It is entitied ‘An act to prevent and punish the obstruction of the administration of justice in the courts of the United States.” It enaets that it spy person or persons shall corruptly, or by any ‘threatening communication, endeavor to influence, intimidate or impede’ any grand or etit jury or juror of apy court of ihe United States in the discharge of his or their duties, or shall corruptly, or by threats, or fore, or by threatening letters, or any threatening commu- | nications, influence, obstruct or tmpede, or en- deavor to influence, obstruct or impede, the due administration of justice therein, such persou or persons £0 offending shall be liable to pro-ecu- tion therefor by incictwent, and shall, on con- victon thereof, be puntshed by fine not ex ing $1,000, or by imprisonment not excee one year, or by both, according to the aggra’ tion of the offense.’ It also euacte that if any | person or persons shail attempt to influence the action or decision of any grand or petit juror upon avy issue or matter pending before sich juior, Or betore the 2a, of which be is a mem- ber, or pertaining to his of their duties, by writing or sending to bim any letter or letters OF ALY Communication, in print or in writing, in relation to such issue or matter, without the order previously obtained of the court before which the said juror is summoned, the psraon so offending shall be deemed guilty of a misdi meanor, aud shail be liable to prosecution there‘or by indictment or information; and shail on conviction thereof be punished by tine not exceeding #1.(00, or by imprisonment not exceeding eight months, or by both, such fino and imprisonment according to the aggravation of the offense.” Now, is you take it that this act does not ap- Ply to this court, then this court would havrethe jurisdiction that the courtsof the states would €, and we all know that almost every state exercises the jurisdiction; almost coextensive with the jurisdiction that was exercised by the Supreme Court of the State of Illinois. There could be no stronger meaning used to inflaence a jury than the publication of articles; such as thore which have been published in reiation to the organization of the jury. This jury was sworn, was tried; was accepted according to the strict rules of law, and they purged themselves. if they have committed perjury in saying that they had not formed such an opinion as would ‘nee them in their ion ip this case, then they are liable to another proceeding. ‘Atter this trial is over; after it has been gone through with; then there may be room for the proper exercise of that liberty which belongs to the press, which can never be construed, however, to be a liberty that is inconsistent wit the Riberty of the other departments of the country, I apprehend that anybody who might be indicte.j nnder any of these acts would prefer to be tried by the rules of law, and to be entitled to his challenges, and to be entitled to the strict holding, as he always should be, and shal! be as long as I am presiding, than to be tried by the mob. It seems this little girl, with a, companton, were crossing 1th street, when they were met by Bill Culeman, colored, who was leading the dog by means of a stout chain sttacbed to his coilar. In passing, Coleman set his deg upon the little girls w frighten tnem, at the same time giving out tue siack in the chain, when the dog sprang upon this girl and nearly tore Ler left ear off, and lacerated the beck part of her bead shockingly; at the same time with its powerful paws stripped her nearly naked. The child’s sereams brought a crowd together, and among them Mr. Lemuel Weed- en, former hostler of No. 2 fire engine company, who darted through the crowd, aud seizing tie dog by its hind legs whirled it above his head and dashed its brains oat on the pavement. The Act was pronounced by the entire crowd as a heroic one, and Weeden received many thanks and for it. Coleman was then ar- rested by Lieut. Skippon on the charge of as- sault and battery. The little girl was taken imto the drug store of Mr. Entwisle, where medical attention was given her. 700 LIGHT A PUNISHMENT, BY HALP. Coleman was arraigned m the Police Court this morning, charged with assault and battery on Rachel Coleman, to which he pleaded guilty. After the hearing of several witnesses the judge sentenced him to six months In jail.
