In the Criminal Court, Jadge Humphreys, this afternoon, a novel case, probably the first of the kind ever tried in this District, was taken up. Samuel B. Murdock, a rather handsome young man about ©} yearsof age, was arraigned on the charge ot having on the 19th day of June last, sent a threatening letter to Hon. Fernando Wood for the purpose of exter ing money from nim uilty. TESTIMONY OF HON. PZRNANDO woop. Mr. Wood was sworn, and testified that on the evening of June 19th two colored boys came to his house andrung the bell. He went to the cor, and they handed him a letter. Witness bad the original letter in his hand. THE LETTER IS AS FOLLO “Sir:—I am satisfied as to your guilt. A LAW POINT. ‘This was all the testimony, and Mr. Miller moved to quash the indictment, claiming that this was net an indictable offence. Judge Fisher said that this very point had been decided in a case in Delaware fifteen Zoat? go, (in which he prosecuted.) It had been ruled that the sending of @ threatening letter was a Ligh misdemeanor. Mr. Miller replied, claiming that there was no authority making thisa high misdemeanor at common law. Judge Humphreys overruled the motion to quash. Mr. Miller asked that an exception be noted Jadge Humphreys brietiy charged the jary and they retired at 2.15, and tn five minutes re- turned “4 VERDICT OF GUILTY.” Mr. Miller fled a motion for a new trial. ——_e—_—_— District ermme! ‘The District Commissioners have decided that the office of inspector and weigher of coal is saperfiuous and unnecessary, and directed that the commissions held by Joseph Smallwood and J. Late Grand Ja an lik a | Was the — egal Interesting Proceedings tn)the Crimi- mal Court To-day. | In the Criminal Court, Judge Hamphreys, this morning, the argument on the plea in abatement filed by Mesers. Cook and Bond yes- terday, in the case of Underwood and Hal | cbarged with forgery of firemen’s certi cates, was resumed. It will be recollected that this plea raises the question as to whether the grand jury, which found the indictment in this ease and the safe burglary case, was properly drawn or qualitiea. Mr. Cook baving concladed his argument yes- y terdi CDGE FISHER FOR THE GOVERNMENT, commenced his argument in reply. He claimed that the motion was really a motion to quash. Asto the point that the lists of jarors should bave been made ‘from time to time,” he said the act of Congress provided that the court may from time to ume, &c., and therefore it was not mandatory. The fact that the court made no farther order than thatof 1571, shows that in the opinion of the court it was unnecessary to make other general lists. Anterior to the act of 1832 the marshal selected the jurors, and he had ths entire control. Judge Fisber claimed that the act of 1s71 repealed the law of 1362. This law of 1571 does not say anything as to the propor- tions to be observed, but simply deciares that the commissioners sball make lists, He argued that these commissioners simply took the place of the marshal. Judge Humphreys at this point asked if the parties were in court, and received the answer that Mr. Hall and Lis counsel were absent. H> then ssked if Mr. Cook desired a severance, and the latter replied in the affirmative. Judge Fisher contended that the commis- sioners might make lists for juries under tbe tot IT. MR. COOK REPLIED, saying that admitting that the law of ‘71 re- pealed the act of 62, then the juries must be wn according to law as it existed at that (’e2), and the jartes as they now exist have not been legally drawn and consequently they are not legal. He claimed that ‘time to tima”’ used in the act implied that there must be more than one order, and oo goog that but one order having been made, the commissioners hay- ing placed the names in the box in 72, they be- came functus officio. He then argued that the names were improperly placed in the box, the box was improperly sealed, and the drawing was improper, in that the clerk drew them. Ho proposed to offer some evinence on this point. EVIDENCE OF THE CLERK OF THR COURT. ‘The Court.—Call the clerk. Mr. Middleton, the clerk, was called and sworn, and stated (after examining the record of the drawing of June last) that he drew the names trom the box; that neither Measra. Bowen nor Wormley were nt, and he oguld not say whether Mr. Phillips was present or not. ‘Mr. Cook continued arguing that the law re- quired that the Commissioners should be pre- rent; that it was not contemplated that they sheuld — prepare the lists and leave thi drawing to the clerk exclusively. He called at tention to the fact that not one of the officers uamed by the order of the court was present. A QUESTION OF TAXES. Mr. Cook at this point submitted the affidavit of Jobn F. Cook, collector, that he had care- fally examined the tax books and does not tind the names of F. A. Newton and Martin F. Reese (who are on the grand jury) on the list of tax-payers. A QUESTION OF AGE. Mr. W. A. Bost was calied to testity as to the age of Gassaway Waters, (one of the jurors sad to b3 over age,) and said that he first knew him about 55 years ago, when he (W.) was about 42 or 43 years of age; that Waters told bim he came to Georgetown 69 years ago, and was then a boy large enough to take care of a horse; that his sister, Mrs. Becket, said she was born in April after the war of ’12; that there were seventeen children in the family and six between Gassaway and herself, and that he was between 70 and 75 years of age. While waiting for Mr. Cook Judge Fisher called the octogenarian, Gassaway Waters, to the stand. He testified that he bad always managed to take care of himseif. He was a married man now; was 25 years old when he was married, and had been married 35 years. He learned hie age from the family Bible, and kept itin bis head; sometimes when asked his age had told people that he was not 100 and someimes that he was not 75. —He had to take Cross-examined by Mr. Bon: Q. Do you recollect the war with the British’ things as they were told him. A. How long ago was that; I recollect hearing people talk about the war years after it. He had heard his mother talk about how his master said the red coats were coming. ‘This closed the evidence. OTHER POINTS. Mr. Cook said that there were some points he had rot argued—that the law requires that the grand jury shonld consist of 23, when there were bit 19 on the list. Mr. Bond said there wasa farther point that the minutes of the court do not show that four members of the grand jury were sworn. ‘The Court.—Who are they? Mr. Bond.—B. Grant, James Ferguson, Foster Henshaw and Joseph W. Harry were drawn. The first was returned non-est, and as far as they find the last three were not sworn. Mr. Middleton, the clerk, examined the record of Jane Isth, (the day on which they were returned) and was sworn, and testiti:d that he personally knew those named and they were orn as grand jurors. The Court directed that the minutes be amended. ; Mr. Bond.—Will you allow us to note an excep- tion. THE COURT SURPRISED. The Court—“Gentlemen there are some things in this case that I amsurprised at.” (To the clerk.) ‘Mr. Middleton after the eatry amending the minutes state that the court ‘in abundance of caution and out of courtesy allows ap exception.’ ” ‘ = this point @ recess for five minutes was aken. THE COURT DECIDES “‘ POR THE GOVERNMENT.” On re-assembling, the District Attorney ‘ated that be had joined issue as to the plea in atement as to the grand jury and as to the pettit jurors he filed a demurrer which he read. ue Court.—I will sustain the demurrer. A Home Disaster to be Guarded Against Wasurneoron, D. C., Sept. 23, 1374. Editor Star: The terrible disaster at Fall River prompts me to call public attention to the condition of things at the Lae print- ing office. Here isa ding in which, amonth later, there will be | ‘teen hundred employes at work, (now about twelve hundred,) double the number employed in the ill-fated granite mill. From the first to the second floors there are three stairways, each not over four feet wide, while there are only two communicating with the other stories, where the females are in a large majority, especially on the upper floor, where there are very few males. There isnot a solitary ladder about the establishment where- by these women could escape in case fire should envelop these stairway-, even did they retain presence of mind to avail themselves of such means, if they were provided. I believe there pte ug A of hose on each story, but it is ex- tremely doubtful if they are in @ condition to hold water, through long disuse. Even were such the case, Potomac water barely reaches the upper floor during working hours. With the exception of the new wing, the entire build- ing isin a condition to spread the flames with terrible rapidity, oil, ink, benzine and paper abounding in the press-room in the lower story. Shinar and Shalhorn, arrested here on Monday, charged with the murder of Kiley, in Leesburg, were, upon a hearing there, al- mitted to bail. It is the general impression there that the charge against them cannot be sustained, as many of the alleged suspicious circumstances have been explained by a more careful examination, or have disapp2ared upon & proper inquiry being institated. It is said that a body believed to be that of Riley was found in the Potomac a short distance above the Chain bridge about two weeks ago, but this is not credited.”’ . Defendant con- tended that he was a citizen of the state of Maryland, and offered to show his lease of the premises executed by the Maryland authorities. Lieut. Austin testified that there was no doubt but bis bar-room is within the District lines, although a portion of his premises is in the state of Maryland.
