The Sapreme Court, in @ tormer decision, denied that the words of the resolution, ‘in the civil service of the United States,” as there employed, should be restricted ‘0 persons fillng offices or holding appointmente established by iaw. The court | rejected that narrow oonstruetion of the phrase, | and unanimously decided that neither a com- mission nor a warrant of appointment is neces | sary to entitle an employs to the benefits of the | joint resolution, provided he was actually and | properly employed in the Executive mansion, | or in any of the departments, or in any bureau | Or division thereof, or in any of the offices spe- cifically designated in the said joint resolation. | In the late decision of the Supreme Court the same opinion was adhered to. The appellants | beid that the fourth section of the appropri- ation act of Jaly 12, 1870, which enacts that all acts and joint resolutions or parts thereof, and all resolutions of either house of Congress grant- ing extra compensation or pay, be and the same | are bereby repealed, to take effect on the first day of July in the same year, was a bar to the right of recovery in all of the cases under con- sideration, and sabmitted several points to show that the claimants could net recover. The court held—(1) That the joint resolution ceased to be operative at the end of the fiscal year in which it was enacted. (2) That such additional com- pensation is allowed only for that year. (3) That the claims in these cases are only for such additional compensation daring that fiscal year. (4) That the joint resolution ceased to be oper- ative at the close of that fiseal year. (5) That the right to sach additional compensation bey came fixed and vested when the year’s services were faithfuliy performed. (6) That the re- pealing act, which it is supposed constitates s bar to the cause of action in these cases, did not become a law until more than three years &fter the right to the additional compen- sation had become fixed and vested and the joint resolution had ceased to be op- erative im respect to prospective services. In conclusion, the majority of the court held that the first twelve persons named (of the four- teen test cases) are entitled to recover, as the claimants clearly come within the meaning of the 20 per cent. resolution. Bat the other two | | claimants—©. H. O. Hoffman and George A. Bell are not entitled te recover; the former be- cause be was employed as sexton in the Arlinz- ton cemetery, in the state of Virginia, and not “tin Washington,” and coasequently his claim is not within the words of the resolution. Nor was the latter In the civil service of the United States within the meaning of that provision, as be was a plate-printer, working under a con- tract atan an agreed rate. a Referring to the affliction of Representative Mellish, the New York Heraid thinks a delicate question arises affecting the personal liberty of & member of Congress, and asks, ‘how does the House know that Mr. Mellish is tnsane? A time may come, as in the | contests for the Speakership before the war, | when the absence of a member for one day might change the political situation. How easy to secure such an absence if members can be taken | to an insane asylam without inquiry on the part | of the House!” This would seem to be a groand- | less apprehension on the part ef the Herald; for | although there are cases of persons being thrast into insane asylums withont the consent of their | friends and the certificate of reputable physi- cians, yet euch cases are not numerous, and | where large interests were involved, asin a con- | test for the Speakership, there would be too many watchful friends at hand to make unlaw- fuldetention possible. Y,. re- cently recovered $50 damages from a liquor dealer who sold whiskey to her hasband—the said busband having subsequently got into a row and recetved severe injuries. The liquor | dealer appealed to the county court on the ground of the unconstitationality of the law | under which he was mulcted, because it im- pairs the validity of a license, which is of the nature of & contract between the state and the dealer. The court affirmed the decision of the | court below, and held the law constitutional | on the ground that the higher coarts of the state have excluded licenses trom the category | of contracts. —————+2-——______ The Gebdate in the Council last evening on the bill fer the equalization of taxation in the Dis- triet of Columbia, reported in our local columns, is worthy the attention of tax-payers, as many good and sufficient illustrations of the injustice of the present system of exemptions in this Dis- trict, whereby the burden of taxation is unequal- ly distribated, are set forth.
