An altercation occurred between the two men, anda fight fol- lowed, during which Mrs. O'Rourke was struck | with a pound weight on the head. fracturing her skull slightly, eince which time she bas been at the Previdence Hospital. This morn- ing she appeared incourt and gave testimony, bat could not say who struck her. Dr. J. it. Retly, who attended Mrs. 0’ Rourke, testified to the character and severity of the wound; that the skull was fractured, and there was consid- erable concussion produced on the brain. He considered it a dangerons wound. Dr. Beall corroborated the statement of Dr. Rett thought there was no farther danger. O'Rourke, husband of complainant, testified that hey was intoxicated when he cam» to his house and insulted bis wife, when she tried to persuade him out of the house, when Key took something ont of his pocket and struck at her, and sbe fell senseless to the floor; Key was very abusive to witness and his wife, and when Key attacked his wife witness threw a weight at bim which he was using in weighing some flour, but he did not hit his wife with it. Officer Kearney testified to making the arrest of Key after he had made the essault and left thehouse. Mr. Carrington, for defence, made an address in behalf of hisclient, after’ which the court imposed a tine of $100 and costs. K-y was then arraigned for assault and battery on James Peake, a colored man. This affair oc- curred just before the assaulton Mra. O'Rouke, and before Key went into thestore.
