Ronettes it ‘THE CONSTITUTIONALITY OF THE ResERVeD Szats Law To ne Teerep.—At the opening of the Police Court this morning, Mr. °. Mor- counsel for Messrs. Saville & Canning, pro- etors of the National Theater, appeared and made a statement to the court that his clients had been before him prior to tie filing of the information for advice as to what course to pur- sue in view of this law; that they are law-abid- ing citizens, and desire to conduct their busi- ness within the laws and ordinances; but they think it a great hardship that they should be restricted in the conduct of their business at a positive loss by any unjust rales; this practice Of selling seats marked “reserved,” meets the wishes and desires of the patrons of the theater. They had practiced this since the opening of the theater, and do not deny it. He, as their coun- sel, was present toadmit the charges in all the informations, and submitted to the judgment of the court, in order that they might go to the upper court on appeal, where he proposed to test the constitutionality of the law, which all on admit is unjust. He suggested that’ judgment be entered in one of the cases, that the other informations stand until the disposition of the appeal case be made known. The court ac- ceded fo this request and Imposed a fine in the case of failure to post up a copy of the law in the lobby of the theater—the minimum amount $5, and the appeal was taken.
