[n this case Corco ran seeks by bill to recover the payment of the bonds they hold. Judge Wylie remarks that | the bill and answer having been amended and stipulations filed there is but one issue in the case, viz: Whether the holders of preferred bonds and coupons are entitled to interest on the unpaid coupons. Had the complainants brought suit w for the interest and proved the demand and bomen iy they would be itled to judgment; but the canal company being so heavily mortgaged a judgment would have been useless, and therefore they come into the chancery court. These bonds and coupons constitute a lien on the revenues of the com- pany. The bill has not ax allegation in it that there is a fund from which they can be paid, and therefore the court cannot enforce the payment. They do not allege that they have demanded payment for the coupons when the very terms of the coupons provided that they would be paid when presented in Baltimore. The canal company shows that when the coupons were presentea and when there were net revenues they were paid. The state of Maryland agrees interest is paid, not interest on interest. The court dismisses the bill without prejudice to the | complainant to sue at law.
