Mr. Shanks opposed the amendment, alleging that he did not want to intrust the work to men who had been driven back by the Modoce for seven long months, and who had a back record to make up, He asserted that there had been strong provocation for the hostility of the Mo. docs, whom he extolled, charging treachery and deceit apon the whites in the vicinity. Mr. Nesmith defended the people of Oregon and the officers of the army, alleging that the delay in conquering the Modocs was not the fault of the army, but of the orders from Wash- a. which was known a: the pow-wow policy. Mr. Shanks interjected a remark charzing the people ot Uregon with the murder of tive prisoners of war, and Mr. citing the murder of Gener under @ flag of truce, and claiming that the provocation to this was very great, owing to the arvey, of the Mississippi, in place of losses gon and a depre repeated acts of treachery on the part of tue | Moxloce. Mr. Shanks, again ebtaining the floor, said that in 1849 this Capt. Jack, who had attained a tion, had a father as dear to him as the fath of the gentleman wasto him. Ben Wright, a man Of some notoriety, had charge of some troops, and invited the father of Captain Jack to a conference under a flagof truce. Ile came, with furty of his chief men, when Ben Wright. in bis own camp, contrived a o- to poison them all. He invited them to a feast, and pro- posed to put strychnine in the beef, but the [n- cians were warned by other Indians, and re. fused to eat the beef. They were then shot down—Jack's father and forty of his men Captain Jack was there, and ‘rom that hour be nad not been the friend of the white man. He bad been tola that from the spot where Captain Jack murdered General Canby be could view the spot where his father was butch- ered, with torty of his men, under a ‘lag of truce. There was much to extenuate the crimes ot Captain Jack. Mr. Nesmith said the gentleman had been reciting a history which, he doubted not, believed to be accurate, but among the dians the question of paternity was very doub’ 1. Mr. Shanks. Mr. Nesmith said he knew Ben Wright well He had marched with him: hanted Indians with him; slept under the same blanket, and eaten mule and horse meat with him. He wasa brave and honorable man, but he had suffered severe- ly, and retaliation was his ruling thought. He thoogbt he could throw some light upon the fia, of truce story. For long years the Modocs bad been been murdering emigrants moving toward the Pacific, who, after enduring all the trials and tolls of @ journey of a thousand miies, were fell upon and butchered with atrecities too hor- rible to relate. There was no flag of truce in this care; Ben Wright had but fifteen men, while the Indians had a large force. A few days before these Indians had murdered an en- tire party of emigrants, and Ben Wright went out to pursue them. Then they had @ confer- ence, and Ben Wright — positive evidence that the Indians contemplated the murder ot his whole party at the council, took time by the forelock, and began the fight. Dir. Shanks said he did not propose to antag- onize the bill, but desired the investigation committed to men who were entirely unbiased, and not to those who had motives for exag- gerating the damages done by the Indians. The gentieman from Oregon had, he said, confessed judgment. Wright, he said, had stated he bad reason to believe he would be attacked. What reason had he to believe he ould be attacked in his Own camp, and while he was paving the way to poison all the Indians with beef at own table’ Why did he kill the beef and prepare the feast if he supposed they were going to murder his party? Do men spread teasts for their murderers? Mr. Lu ttrell, interrupting, said there was no trath m the a story. Mr. Shanks said there was another provoca- tion to the Modocs. A treaty bad been made with them which was unconfirmed, and they had been driven about until they turned around and fifty-three of them fronted the national co and tought it. He denied that the lay was caused by the peace commission, and ci the instructions from the Indian de} - ment placing them under the control of na eral Canby. Mr. Luttrell denied the truth of the amg | sory. He said he had lived in the — java beds. He knew Ben Wright, no braver or more honorable man ever lived. The story was gotten up by those sent out by che vernment, who went there not to the fiene, but torodthem. He had been in the lava beds with Ben Wright and bis men, and they oe a there was otis word of truth in the story. There was no prepared, and no chnine Or arsenic purchased or used. A train with twenty-seven emigrants from Indians and Illinois had reached vicinity a Tew di before, and every one of them had been murdered by these Modocs. and their bones left bleaching on the plains. This story was sustained by the best- men in that section. Mr. Shanks asked how many of Wright's men were killed?
