It is well known tbat the democratic candi- Gates have carried the elestion in Texas by § majority of over forty thousand votes. Various causes are assigned for this, but among them is not the want of a reasonably full vote. The chief is probably the unpopularity of the very expensive administration of Governor Davis, the enortsous public debt created; and the dis- satisfaction of a large part of the republican party with the candidates. Since the election questions have arisen, which seem likely to give trouble. Those questions relate, first to the legality of the election itself, and, second, to the tenure of the offices of the present incumbents. ‘The constitution of 1269, by Congress 30th March, 1 ,) read as follows : * All elections for state,district and county officers shall be held at the county seats of the revert counties, until otherwise neg by law; and the polis shall be opened four days, from eight o’clock a. m. until four o’clock p. m. | of each day.” Under this section two regular elections were | held. A Mexican having exercised that ancient privilege, was arrested and committed , for trial. Mr. Ridge Paschal brought the Mex- ican before the supreme court by Ae@leas corpus, upon the assumed ground that the election law | if void, and that therefore there was no elec- tion, and no offence. The case is to be argued to-morrow by eminent counsel upon beth sides; and the decision is looked for with the strong anxiety which presages anarchy and revolution. ' Should the decision be in favor of the election jaw, or the legislature meet in January despite the decision, there yet remains another difficulty ahead. Article 1V, section 4, of the new con- stitution reads as follows “The governor shall hold his office for the term of four years from the lime of his installment, and until bis successor shall be duly qualitted. He shall be at least thirty years of age, a citi- zen of the United States, and sual have beon @ resident and citizen of the state of Texas fur three years immediately preceding his election. He shall be inauguraf-d on the first Thursday after the organizati ae Jegislature, OF a8 800n thereafter as p: Governor Davis was eiccted on 34 December, 1560. He was soon afterwards appointed pro- yisional governor. But the legisiature which assembied in February, 1870, ratitied the consti- tutional amendments, elected Senators, and adjourned without inaugurating the governor. After the action of Congress upon the consti- tution, the governor called the legislature to- gether im April, when he was regularly inaug- urated. The attorney general appointed by the governor has giyen his opinion, that the terms of Governor Davis and the other state officers, will not expire, until the date of his inaugara- tion in April. On the other hand Governor Coke will insist that his term of office will commence on the day of his inauguration, the first Thursday in January. In favor of this view is the fact, that Davis approved the joint resolutions ratifying the constitutional amend ments, commissioned the Senators, and did eundry other acts as governor before he was in augurated. This | “Xt interference becomes a serious matter when such deviltry is resorted to as placing obstrac- tions on railroad tracks, misplacing switches, and putting soap in the water tanks, (see our Aispatches to-day,) by which the lives of hu: <lreds of people, who have nothing to do with | | their wages controversy, are endangered. T miscreants guilty of such acts should be prompt- | ly and severely punished. Qf conzyg no one believes that any ai8°“‘ation of Americ::; workingmen wou} be guilty as a body of such murderous deedz, or that the great majority of the striker. have any hand in these atrocious acts OF Sy knowledge of them beforehand; but | the ‘ess conscientious men who are guilty of them attempt them because they believe they will have the countenance and support of their fellows in their efforts to further the cause they bave at heart. Labor associations whose mem- bers are suspected of such deeds should not content themselves with resolutions denouncing them, but should be active in ferreting out the criminals and bringing them topunishment. It is @ duty they owe to themselves. Congress should be careful not to be “penny- | wise and pound-foolish” in its appropriations | for the support of the government. There are, doubtless, some estimates which may be reduced without detriment to the public service, but there are many others where every penny asked for should be granted. For instance, it is stated that the Postmaster (ieneral will ask for a spe- | cial appropriation safficient to enlarge the pres- | | ent postoffice bulding. This shoald be granted- Already the department has been obliged to resort to the practice of renting quarters outside Of the building proper, which lacks sufficient ac- | commodations. The enlargement of the build- | ing would, however, be a mere temporary ex- | pedient, as ina few years it would again be | found too small. Whatthe government needs | is a new post office building, at least twice the sizeof the present structure. The latter can then be turned over to the Interior department which could utilize every foot of space in it, and thus save the payment of a large amount Of rent for outside accommodations yearly.
