An insurance case ts pending in Baltimore. Im 1867 one Bowman purchased of JJotn W. Walker, of Danville, Va.,a distillery property for $30 000. He had the property insured for ‘$17,000 in several offices before his title was per- fected, and on the Ist of May, 1568, it was | burned. Previously, however, judgments were entered up against Walker, some of them being entered before Bowman's deed. The Franklin | Fire Insurance company resisted payment on | the ground that its policy stepulated that not | disclosing encumbrances when the policy was taken out should work a forfeiture. General | Bowman not knowing of the defects could not | have disclosed them. The defendant has proved that the butidings were tired by a colored man, who was paid $500 for it by Walker, but the court rejected all the testimony relating to fraud and incendiarism on the ground that it did not connect Bowman with the fire. The counsel are now being heard before the coart on the following points: First, the policy re- quires a statement of encumbrances, and none was made by Bowman when he got his insur- ance, nothing being said about the judgments, claims and outstanding rights of other parties; that the nature of Bowman’s interest under the deed from his partner, Walker, is ngt explicitiy set out in the policy, as required by its terms, and in which he insures as a tee simple owner, and does not disclose Clarkson's partnership in- | terest in the land or machinery, and that the | policy falsely stated that the property was sur rounded by a high board fence; that the notice of the fire was given too late, Ko. +202. - The committee on teachers of the board of Teport in favor of the restoration of corporal punishment in the public schools, and it will be considered at the next meeting of the board. | ‘The committee state that the teachers are unan- imously in favor of corporal punishment in the case of incorrigible boys, and are of the opinion that such a change woukl be not only highly beneficial, but that it is indispensable to the proper discipline and general progress of the schools.
