The report fr m Havana, printed in yester- d@ay’s Stan, regarding the execation of the Cuban captives on board the steamer Virginius caused considerabie excitement both in official and other quarters. As yet the only oficial ia- telligence received .at the Department of State Is that the steamer was captured six miles from the coast of Jamaica by the Spanish ganboat Tornado. The Sec- retary of State upon receiving the information atonce telegraphed Minister Sickles, and at his instance instructions were sent from the Spanish government at Madrid to the authori- ties at Havanna to await orders from he home government before inflicting penalties, other Than holding them as prisoners, upon the cap. tured crew aud passengers. This order was probably received on the evening of the 5th or morning of the Cth, tod late to be reapect- ed, as the executions took place on the 4th. It is impessible at this time to determine the exact status of the Virginius. General tele- graphie reports canrot be taken by the State department as authentic, and even if sojthey ack the details necessary for the just disposi- Lion of senious questions of diplomacy. | Secre tary Fisk, however, does not anticipate any trouble. He says the Spanish government is opposed to quarrels, and it subordinates act hastily, we must not forget the apolo, made to England during the rebellion for the capture of Mason and Slidell. Spain is in much the same condition to-day as the United States was in 1862. England was satisfied with our course, should we not be satisfied with due explanation from the Spanish government? He says he is satistied that the intention of the Spanish government is pro- longed peace, and that this belief is bi on 8 lence as need net be repeated now. Whatever there is in diplomatic correspondence will be hastened either by cable or maill. The question has been raised whether the Virginius was captured in neutral waters, or whether she had violated the neutrality laws. Inquiry in official circles fails to elicit a direct opinion In reference to this in- terrogatory. No additional particulars have been received by the Department of State up to the hour of going to press. Gzrzrat BuTer has won again. And now, after the lapse of years, as one by one his New Orleans measures often denounced as high- handed and arbitrary, come before the scrutiny of the courts, they prove to have been each of them the work of a clear, cool-headed, decisive man, who combined with the administrative abilities of a military governor the sober logic of the practical lawyer-—.V. 1”. Commercial. Close of the Udderzook Murder Trial. CHARGE OF JUDGE BEITLER. At the afternoon session of the court yester- day, in the Udderzook murder trial, Mr. Wag- ner. for the prosecution, made the final address to the jury. He reviewed the testimony of Samuel Khodes and the letter written to him by Udderzook, and claimed that they stood oat, convincing and unassailed; as powerful arga ments of the prisoner’s guilt. Judge Beitle then, at 5:15 o’clock, proceeded to charge jury. Atter stating what constituted marder, be said that the case of the commonwealth rests on what is known as circumstantial eviden and this kind of evidence is ascertained by perience to be little, if any, less satisfactory than that known as direct or positive evidence. ‘The first question was, were these the remains of a person who died by violence? and the next, was the victim Winfield S. Goss? Then camo a review of the manner in which Goss had his life insured, and how he is reported to have lost it in the fire in Baltimore, and how the oy! was found in the ruins. Was this the ly of Goss? The evi- dence of Mrs. Goss fell short of identification. Reverting to the ring, he thought it would be better to conclude that Wilson had a ring similar in size and color and general appear- ance to that worn by Goss. The significance of the fact that, according to Engle’s evidence, Goes had been in the habit of addressing Ud- derzook as “Doctor” in Baltimore, and tit was shown that he had addressed him by the same title in New York, was a fact of consiter- able significance. Regarding the pictures, too much importance should not be attached to the fact that witnesses were not able to point the particular parts of features as their objects of recognition. Now, was this man who lived at Cooperstown, went to Athensville and subse- quently appeared in Newark, Wintield S. Goss under ‘an assumed name? Eyen if you deter- mine that this was eo, you have made but astep towards connecting him with the death in Bear's woods. It was for the jury to determine whether it has been sufticientiy [igen that Wileon was Goes, and if so, did the ? Refe to the allegation that Udderzook had entered into a conspiracy to defraud the in- surance companies, and that it became neces- sary to put out of the to insure the success of the EE he said that if Goss was not burned, and that Wilson was Goss under an assumed name, then we have connected the risoner with the crime. The testimony ot jamuel Rhodes was then reviewed, and the jury told they were to determine what the inter- view with Rhodes and the letter to him meant. It is shown that the prisoner and the stranger were last seen going in the direction of Bear’s woods, Were the remains found in Bear’s woods those of Winfield S. Goss? If they are, did William E, Udderzook kill? If fiod him guilty, you must find him guilty of murder, and ‘ou must then determine whether murder of the rst or second degree. If there is reasonable doubt, you must give him the benefit; butif, on the contrary, you believe from the facts before you that being 4 committed the crime, you must find bim guilty.
