Among those Tesent were Superintendent J. 0. Wilson, i rustee A. Hart, Adolf Cluss, the architect; Mr. T. M. Shepherd, and others. The hall occupies the entire fourth floor of the main building, and is pear-shaped, the stem portion being on the south side, occupied with a platform or stage. ‘The floor is raised, and along the south front runs @ gallery, arranged in asemi-circle. The walls and celling are handsomely frescoed, and the entire woodwork of the room, including window frames and sash, the front of the ga and the door frames are of North Caro- fina pine, oiled and polished; with the exception et the fresco there {s no paint about the room. ‘The seating capacity of the hall 1s about twelve hundred, the seats being @ late patent—iron frame, with wood back and bottom—arranged | in a semi-circle. The heat is supplied by six bronzed steam radiators, placed at proper points | around the room, and the light Is faruished by the latest style fixtures. In the center of the room is the main chandelier, (a patent reflector.) the body being of gilt, elaborately chased. Around the outer edge are sixteen gilt-three- bramch brackets, each burner being fitted with a ¢T)*\ad imitation candle. The inner circle, below the rafector, is composed of tweuty-four piain jects, the effect, when lighted, being beautiful. mmediately over the stage is a similar but smaller chandelier, composed of forty-eight lights. The following is the opinion of Judge Mac- Arthur, delivered im the court iu geveral ter: On Saturday last, in the cate of Max Luchs, a: fae gory oo Parkeron Jones, appeiice, (land ord and tepant,) and it wal! be read wath inter- eet by persons interested im real estace ~ Pile action Was commenced befure a aati the statute “to regulate landlerd and tenant,” ju possesston of the prem- ises in dispute, and the defendant appealed to this court. (On the trial in the special term the Judge presiding im-tracted the jury that “There Was no evidence comdacing to prove sach ten- ancy as authorized this proceeding, sad. they must therefore find a verdict for defendant.” A verdict was returned in accordance with this in- struction, and an sppeal was taken therefrom te the general term upon a bill of exceptions. it also appears that the plaintiit read in evi- dence at the triala deed of trust execated by the defendant who was the owner of the pre: im question conveying them to Philip a. neiile, trustee, dated March 8, 1870. The deed recites that the defendant Jones had given bis promissory note to George P. Needham, for the to secure the payment of this note the said deed of trust was executed. It contains the u: power authorizing the trustee upon devaul! being made im tae payment ef the note to sell the premises, and to convey them in fee simple to the purchaser. Darnetlle was introduced by the plaintitt and swore that he was the trustee named im the ceed, and that he d the premises and conveyed them to the plaintiff, who was the purchaser The plaintif® aiso proved that the defendant remained in porsession withoat his content, and that he had served him with a notice of thirty to quit and surrender the premises. This eutstantial st in the billet exeepuens apon which the court below directed a verdict tor defendant. I was of opmion then that the relation of landiord and tenant between the parties could mot be int from these cireumstagees, so as to bring the canse within the stafute upon which it was founded. A careful examimation of the lan- gage used in the first section has satistied me that in this respect ‘my constrnetion ot the act Was erroneous, and al! the judges who heard the case here are of the same Opinion. ‘That portion of the.dirst sectiom which is to be considered in disposing of this case reads as fol- lows: ‘That @ tenancy at will shall not arise or de created without an to that effect, and that ali occupation, posses- sion, or holding of amy measuage or real estate without express contract oF lease,or by such contract or lease the terms of which have ex- red, shall be deemed and held to be tenancies y sutterance; and all estate at will or sutfer- ance may be determined by & notice in writing, to quit, of thirty days, delivered to the tenaut band or to some person of a the premises, or in the HE here provided for—one bels, other by sufferance, and that both “m: termined by a notice to quit of thirty also that creat possersion, or ofreal ce at & contract, or by one, the terms shall d a ten- sion where there is no contract, isa cient cireumstance to create such tenancy; end if a én therefore holds possession of premises be- longing to another, and there is nO agreement between them, the relation of landiord and — arises by the mere operation of the stat- ute. At common law an estate at eufferance is where one comes into possession of land by lawfal title, but keeps it afterwards, without any title atall. As if a man takes a lease for @ year, and after the year is expired continues to hold the premises withoat any treeh leave from the owner of the estate.—(2 Black- stone, 150.) italso occurs where the tenant wiltully holds over after the determination of his term. But the actin force here relates to all occupation or possession, whether with or without @ previous contract, and declares in explicit terms that such possession is the ample Feguisite to constitute a tenancy by sufferance. &m aware that in several of the states it has been decided that in order to authorize the institution of summary proceedings to recover the possession of land the relation of landlord mises Dar- umn of $950, payable in twelve months, and Ment of the facts contained presecontract or letting ennewe Wantnce doom “nana Lids A Pains TO-DAY. porter hoase), ), 28e; do.
