In the report of the trial, elsewhere, the ground for this libel suit is given in @ locat article in which was told the story of an odd case of mixed identity, in which a well-known and much-respected avenue merchant by mis- take gave a rather rough handling to quite snother party than the one he was looking tor through his bearing the same name. Judge Cartter,in the course of the trial, very aptly described it as “The Comedy of Errors.” It was shown that, with the exception that the grievance to the indignant husband who under- took the chastisement in question was an alle- gation about a counterfeit note, instead of kleptomania, the main features of the item were as related. It was shown, aa heretofore Stated, that the item found its way into the paper through the ordinary news channels; and that so far from there being any malice in the matter, the relations of Prince with the paper were of the most friendly character, he being an advertiser; and that on the attention of the editor being called to the item he male a cor- rection worded in exact acco-dance with what he ed hearing of the t understood the wishes of the plaintiff to be. | Prince was not le to show that he had lost a penny by the publication or that he had baen injured in reputation, of in any other way by Yet he seemed to think that something m’ be made out of Tae Stan,and entered ali suit. But alas for the vanity of hamanexpectations! Never was somuch sweat, ges- ticulation, and fervid oratory expended in vain. Particularly concerned were they to check the licentiousness of the press, and especially the Washington press; and referring to the opinion of Judge MacArthur that Tas Sran is the mos" decorous of the papers here they argued that that was not saying much, and proceeded to quote frum the columns ot other Washington papers to show that Taz STaw should be pun- ished for their sins. Bat the well-meant and disinterested effort failed. They got nothing. instead ef dividing $20,000 they will be called upon to divide costs of court, In the course of thelr tirade against the press they bar something to say—diselaiming at the fame time any reference to the defendants— about “evitors without intelligence or princi- ples,” who fill their local colamns with libeloas matter. Carrying out the same idea, and dis- claimieg any reference to the counsel for the plaintig, would remark that if there are any lawyers “without intelligence or princi- ples” who seek to fill their pockets by despoiling bewspaper men, let us hope that euch verdicts as that of yesterday may teach them a lesson. The verdict is of course gratifying to us, and mainly because it is a vindication of the rights of the press. In view of the expense, vexation, and lossof time involved, it would have been cheaper to hi quietly accepted the ver- dict of the first trial and paid the damages; but we felt that there were rights and princi. ples at stake that demanded a fight at our | nt Be hands. Had we succumbed quietly to that | Lodgesare raternaily muied io bc outrage, it would have been a precedent put- ting the press at the mercy of every speculator. We have fought it out with a re- ult that we hope will tend in some degree to establish the mghts of publishers on a firmer footing than they have held under the narrow rendering of the onerous, antique lawsof libel. We should add, in this comnection, that the rulings of Judge Cartter, always luminous, impartial, and characterized by a disposition to get at the exact truth in any case before him, in this trial presented some points of no little interest to journalists generally; and these giving his constraction of the libel law were embodied in his charge to the jury, as follows:— CHARGE OF THE CouRT.
