Sampson Tyler and James Miller, both pound men, charged with assault and battery on Isase Doland, who testitied that his cow was tied to his wagon, near by where he was mending a fence, and these men came along and tried to take ‘bis cow, and on his protesting, Tyler knocked him on the head with the hickory han- dle of a pick, breaking it in two. Witnesses corroborated the statement. Mr. Browne, coun. sel tor defence, in witnesses to prove that Tyler was not the man who struck Isaac, aud that it was a case of mistaken identity.’ Mr. Closes, prosecuting attorney, introduced. other es to rebut their testimony, and the court fined the accused $60 each; ‘appealed. TRE FREUND CIVIL RIGHTS Case. Frederick Freund, keeper ot the w: res‘aurant on the northwest cornerof 1 ind Pennsvivania avenue, was charged, on the eato of K. W. Tbhompkins, colored, with violating tho law regulating restaurants, by refusing to serve him and other colored persons with re- frechments. Thompkins testitied that he a his companions ordered peach cream, and that the waiter returned with a price list, in which peach cream was put down at $2. One of them thea ordered it at any price, and the waiter returned and required payment in advance. Witness then went to the bar and asked the pro- prictor if this was the usual manner of treating their customers. ‘The reply was that they went by their rules, which had been shown them. Witness thought this was not their cus fom, as he had been informed by others. ‘They were in there but two or three minutes. Wh. Axgusta, oneof the same party, testitied to about the same thing. On cross-examination it was shown that one of the complainants called the waiter “a tool; Mr. Freund was not present; lad been there before and had not been required to py in advance. John W. Butler testified to the same thing. Augustavus W. Clapp testitied that he went to the same place on a previous occasion, and that no card of prices was presented to him. The arrest was made on intormation of a colored man named Philip Timbers, who said having broken out of the Culpeper county jail last summer,where he was confined to await his trial on the charge of murdering @ colored man named Bill Brown, about iaet Christmas day, by cutting his throat. The prisoner was turned over to chiet of detec- tives Clarvoe, who now has him in charge, and will return him to the Virginia authorities o1 presentation of the proper papers. Since his commitment the prisoner has been confronted by his aceuser, who fully recognizes him; but Gentry denies all knowledge ot the act, or that he isthe man. While driving up her cows she was taken with a congestive chill, and was carried to her home, where she soon expired. Coroner Patterson was notified, but deemed an injuest unnecessary, as she was very old and feeble, and evidently died from natural causes. Wxporna.—On Monday evening Mr. H. D.
