Even if it was, they would not bave expired until October Ith, and she was forcibly removed October 4th! It was a question tor the jury to determine from the evidence what the one-fifth of the protits prebably was. ‘The evidence was conilicting as to the amount of prouts. Hence the court would have erred by taking that question from the jury, and instructing them as prayed by th fants, that the plaintit! could only re nominal damages. It is true the burden of Was on the plaintiff. She established the bi of the contract by the defendant; and showed the books of the hotel were in the defendant's exclusive possession. She then had the only seuree, other than general testimony, by whic the jury could ascertain with certainty the ex. tent of business dene and the protits realized, and he could have rebutted the plaintif’s testimony by producing these books, and doubtless would have done so if they did not sustain her. After referring to the testimony the plaintiff contends that whether defendant said be looked over the transom and saw her in bed with Capt. Denty or accused her of being in bed with Capt. But it is for the jury to ind the intent with which they were uttered, and whether the words spoken are applicable to the plaintiff, and in this case the defendant did not object the testimony of Mr. Clayton, which removes any possible doubt what disrep- utable, criminal offense he charged the Plaintiff had committed. All authorities agree that testi- mony of wordsof similar import to those charged in the declaration, spoken either before or after the bringing of the suit, are admissible to show matice.
