Mr. Merrick professes to be very much afraid of mixed schools. schoo! bere unless we send a democratic dele- gate up to Congress to say to that body: “You shan’t give us mixed echools. I am instructed by the demecrats and ex-rebels of the District of Columbia to say that we won’t have ’em.” With the red rag tlannted in their faces after thiszort, the likeliest thing in the world is that Congress Will blister us with mixed schools on the instant. But if we elect a republican legisiatare and a Tepublican delegate to the House of Represen- tatives, then Congress will feel that the rights Of the colored men are safe here and will not Press the mixed school question, leaving it to be de, Ir with by the local authorities. The repub- licans have been in power here for some years, and have never broached the question of mixed Schools, hav ng as profound a sense of their in- advisability as Mr. Merrick can himself, and i ie quite certain that bad not that gentleman been sorely pressed for some plank to keep him attoat in his canvass, it would not now have turned up. We shall not have mixed schools unless we send 8 democrat to Congress to raise the issue. ©0Ds not well instructed in such matters that the bankrupt act has been repealed or has expired by limitation. This is not the case. It isstill in effective operation and has become probably like @ similar law in England, a permanent branch of the jarisprudence of the country. ‘Several sections of the act have been amended since its passage in March, 1367, but it Is still substantialy the same. Since January, 1369, when the fifty per cent. clause took effect, the applications of debtors for tts benefits have considerably diminished, while on the other hand the involuntary cases have been steadily increasing, and will probably continue to, as the commercial community and the bar, come to a better understanding of the involuntary provisions of the act, aud find that it furnishes a very short and not expensive method of collecting claims against failing debtors. All persons applying now for the benetits of the bankrupt law must, im order to obtain a discharge, schedule assets equal to fifty per Cent. of their debts on which they are liable as Principals, or, failing im showing this amount, they must obtain the consent of a majority in value and number of their creditors who have proved their claims. Under this latter pro- vision many insolvept persons who have the @ympathy and confidence of their creditors are be to go through without épposition. There Seems to be @ general disposition amongst ered- itors to give honest men @ fair chance to com- menee life anew, after having surréndered their entire estates for the payment of their debts. ‘The involuntary clause of the act should be bet- ter understood by traders and commercial men generally, for it involves, as interpreted by the courts, some very important principles for the consideration of the business community at large. It is generally held by the bankrupt conrt« that a trader who is not able to pay all his debts in the usual and ordinary course of business, as persons carrying on trade usually do, is insol- vent within the meaning of the bankrupt law; and if such insolvent commits what is known in the law as an act of bankruptcy, such as dis- posing of his property by gift, sale, or transfer, 80 as to hinder or delay his cresitors,or by giving ® preference in payment or security to One or more of them, or to suspend and not re- sume payment of his commercial paper within & period of fourteen days, he may be adjudged @ bankrupt on petition of one or more of his creditors. There has been s genera! tendency in the courts furthermore toward a liberal construc tion ofthe exemption laws in cases of bankruptcy, and against the policy of stripping the debtor of everything im his possession, and tarning him and his family out destitute upon the world, and delaying bim in resuming business and earning an honest living until a complicated insolvent estate is settled. They hold that pub- lie policy as well as humanity forbids that a man’s creditors should be permitted to redace him to a state of pauperism or compel him to be idle; that the unfortunate debtor who honestly surrenders all he has towards the payment of bis debts at the demand of his creditors, is enti- tiled to protection from those who would punish him for bis misfortunes. The law ts compara- tively new in this country and one of much importance to the business community, for whose information we have written what is here Said, and to contradict the impression that there has been any suspension of the act or material change in its provisions. ——+2ee- Did Mr .
